Under its terms, Horizon Mobile was authorized to construct, use and operate certain facilities covered by the License between January 30, 2000 and Tuesday, January 30, 2024. However, the License also contained as a condition of its grant that construction and commencement of operations of the covered facilities were to be concluded by no later than Saturday, January 30, 2010. Further, Condition # 5018 of the License stated that, barring)the filing of a formal request for extension of time to construct (FCC Form 701), the License was to be "forfeited automatically" should the facilities not be ready to be operated by the stated deadline. No extension request was filed by Horizon Mobile and construction was |not undertaken.

May 01 13 04:51p Adam Thompson 18007685989 p .2 Additionally, the grantee was required by the terms of the License to file with the Commission a duly executed certification upon completion of construction and commencement of operation. No such certification was filed. Finally, due to changed business and customer cireumstances occurring affer the grant of the License, no use was ever made of the License by Horizon Mobile. In sum, Horizon Mobile elected neither to construct nor operate facilities under the License. Notwithstanding this, the License continues to be reflected on the IBFS data base as ne reflecting a currently valid operating authority. In order to remove confusion, clarify actual status regarding the License and to perfect the accuracy of the Bureau‘s database, Horizon Mobile hereby formally surrenders its License. For the foregoing reasons, the referenced License is surrendered.
