Special Temporary Authority (STA)


SES Americom, Inc. ("SES Americom") is granted STA, for 60 days, beginning May 12, 2017,
to operate a 9—meter Ku—band antenna at its new fixed earth station in Somis, California located
at 34° 19‘ 31.2" N.L, 118° 59° 43.6" W.L to provide telemetry, tracking, and control (TT&C)
functions for the SES—10 satellite (Call Sign $2950) at orbital location 66.9 degrees W.L. using
frequencies 14005.0 MHz (V) and 14499.0 MHz (H and V) (Earth—to—space) and frequencies
11702.5 MHz (H) and 12197.5 MHz (V) (space—to—Earth). Operations will be under the
following conditions:

1.   EIRP density of TT&C transmissions are limited to the limits requested in IBFS File No.
SES—LIC—20170407—00375.
2.   Operations, shall not cause harmful interference to, and shall not claim protection from,
interference caused to it by any other lawfully operating station and it shall cease transmission(s)
immediately upon notice of such interference.

3.  In the event of any harmful interference under this grant of STA, SES Americom, E170090
must cease operations immediately upon notification of such interference, and must inform the
Commission, in writing, immediately of such an event.

4.   Transmitter(s) must be turned off during antenna maintenance to ensure compliance with
the FCC—specified safety guidelines for human exposure to radiofrequency radiation in the region
between the antenna feed and the reflector. Appropriate measures must also be taken to restrict
access to other regions in which the earth station‘s power flux density levels exceed the specified
guidelines.

5. The licensee shall take all necessary measures to ensure that the antenna does not create
potential exposure of humans to radiofrequency radiation in excess of the FCC exposure limits
defined in 47 CFR 1.1307(b) and 1.1310 wherever such exposures might occur. Measures must
be taken to ensure compliance with limits for both occupational/controlled exposure and for
general population/uncontrolled exposure, as defined in these rule sections. The FCC‘s OET
Bulletin 85 (available on—line at www.fcee.gov/oet/rfsafety) provides information on predicting
exposure levels and on methods for ensuring compliance, including the use of warning and
alerting signs and protective equipment for workers.


 6.  Grant of this authorization is without prejudice to any determination that the Commission
may make regarding SES Americom‘s pending application IBFS File No. SES—LIC—20170407—
00375.

7. Any action taken or expense incurred as a result of operations pursuant to this STA is solely
at SES Americom‘s risk.


This action is issued pursuant to Section 0.261 of the Commission‘s rules on delegated authority,
47 C.F.R. §0.261, and is effective immediately.

SES Americom,     Inc.   requests special temporary authority to begin operating the Ku—band earth
station located in its South Mountain,       CA teleport   (E170090)   described in file number SES—LIC—
20170407—00375 for 60 days beginning May 11,       2017 to provide TT&C and communications service for
SES—10, which will be located at 66.9 W.L.        The temporary authority is requested while the
underlying application remains pending.

                                         Waiver Request

               By this application, SES Americom, Inc. ("SES Americom" or "SES") seeks a

license to operate a new earth station antenna in Somis, California to communicate with the SES—

10 satellite and other U.S.— and foreign—licensed satellites included on the Commission‘s

Permitted Space Station List. SES Americom‘s affiliate, New Skies Satellites B.V. ("NSS"), has

been authorized to use the SES—10 satellite to provide service into the United States, and has

asked SES Americom to provide earth station service to support market access in the United

States.1 The earth station will operate in the below bands and as further described in Schedule B

to the attached Form 312.

               SES requests limited waivers of the Commission‘s requirements in connection

with the instant application. Grant of these waivers is consistent with Commussion policy:

                      The Commission may waive a rule for good cause shown.
                      Waiver is appropriate if special circumstances warrant a
                      deviation from the general rule and such deviation would
                      better serve the public interest than would strict adherence

                       to the general rule. Generally, the Commission may grant a
                       waiver of its rules in a particular case if the relief requested
                       would not undermine the policy objective of the rule in
                       question and would otherwise serve the public interest."

               Section 2.106 and Footnote US271. The SES—10 Grant included a waiver of

Section 2.106 and footnote US271 permitting NSS to provide service into the United States at

67° W.L. using the 17.3—17.55 GHz band, which is allocated for the fixed—satellite service but

limited to use by broadcasting—satellite service ("BSS") feeder links.4 At 66.9° W.L., the SES—10

spacecraft will be located 2.3° from the nearest BSS Feeder link Plan assignment and 5.4° from

the nearest operational BSS Feeder links at the nominal 61.5° W.L. location. As described in the

SES—10 Petition, BSS feeder links are similar to other FSS operations using large earth station

antennas that can share on a roughly two degree spacing basis. Furthermore, operations in the

17.3—17.55 GHz band will be on an unprotected, non—interference basis. Thus, granting a waiver

will not undermine Commission poiicy because BSS operations will be fully protected.

               Section 2.106 Footnote NGS2. SES Americom also seeks a waiver of footnote

NGS2 to permit the reception of U.S. domestic services in the 10.95—11.2 GHz and 11.45—

11.7 GHz bands on an unprotected, non—interference basis. The Commission has granted a

waiver for SES—10 to provide domestic service in these bands.5 Footnote NG52 was intended to

preserve access to the 10.7—11.7 GHZ spectrum for terrestrial fixed service ("FS") stations by

limiting FSS use of the band to international operations only.6 SES—10 will meet the power flux

density limits on the ground to protect FS opelrations,7 and the number of antennas that will be

used to communicate in these bands will be limited, thereby ensuring protection of FS services.

Moreover, because SES seeks authority to receive in this spectrum on an unprotected basis, FS

use of the band will not be constrained. Therefore, grant of the requested waiver will not

undermine the purpose of the rule.

               For the foregoing reasons, SES Americom requests that the above waiver requests

be granted.
