SkyWave Mobile Communications Corp. Conditions to Grant IBFS File No. SES—STA—20081210—01591 SkyWave Mobile Communications Corp. (SkyWave) is granted Special Temporary Authority (STA) for a period of 30 days, from December 20, 2008, to January 18, 2009, to use the E030055 earth station license to communicate with the Inmarsat—2F 1 satellite at 142° W.L. in its previously authorized L—band frequencies in accordance with its STA request, the Commission‘s rules, and the conditions set forth below. 1. All operations shall be on an unprotected and non—harmful interference basis; i.e., SkyWave shall not cause harmful interference to, and shall not claim protection from, any other lawfully operating station. In the event of any harmful interference as a result of SkyWave‘s operations, SkyWave shall cease operations immediately upon notification of such interference, and shall inform the Federal Communications Commission (FCC), in writing, immediately of such an event. 2. With the exception of authority to communicate with the Inmarsat—2F 1 satellite at 142° W.L., all technical parameters of the EO30055 earth station shall remain as currently licensed. 3. Within 20 days of this grant of STA, SkyWave shall file with the Commission the applicable items of information listed in Sections 25.114(c) and (d) of the Commission‘s rules, 47 C.F.R. §§ 25.114(c) and (d), for the Inmarsat—2F1 satellite. If SkyWave does not file this requested information within 20 days of this grant, this authorization will not be one relating to an "activity of a continuing nature" for purposes of Section 1.62 of the Commuission‘s rules and Section 558(c) of the Administrative Procedure Act, and continuation of operations beyond the term of this authorization will require prior affirmative authorization by the FCC.
