REQUEST FOR EXTENSION OF SPECIAL TEMPORARY AUTHORITY November 2008 New ICO Satellite Services G.P. ("ICO") hereby requests a 30—day extension — through December 26, 2008 — of the Special Temporary Authority ("STA") originally granted to ICO‘s North Las Vegas, Nevada Ka—band earth station (Call Sign 070290) to conduct certain in—orbit testing ("IOT"). Grant of the requested extension will allow ICO to continue its analysis of the performance of advanced software with the highly precise spacecraft elements that are the key components of the GBBF system. ICO requests authority to continue to conduct tests described below for a period of 30 days from November 25 through December 26. ICO is currently conducting a series of tests to ascertain the functionality of its two—way ground based beam forming ("GBBF") system by simulating forward traffic loading using CONUS and spot beams. ICO recognizes that operations under this STA that are at variance with the underlying licenses for this earth station will be performed on a non—harmful interference basis, and is prepared to terminate all such operations immediately upon notification from the Commission that harmful interference is being caused thereby to any authorized user of the frequency band. ICO requests that the Bureau extend the STA to operate the Ka—band antenna for a period of 30 days ending December 26, 2008. Grant of the requested STA will allow ICO to continue the verification performance of its innovative GBBF technology in a detailed way. The requested extension will thus ensure the effective and timely provision of service to customers in the United States, and is in the public interest.
