PanAmSat Licensee Corp. herein requests a grant of STA for 30 days, from 06/24/2009 through 07/23/2009, to use its Castle Rock, Colorado Ku—band earth station, call sign KL92, to provide LEOP services for the Terrestar—1 satellite that is expected to be launched on 06/24/2009. 13. Exhibit A SECTIONS 25.137 AND 25.114 The legal and technical qualifications of the TerreStar—1 satellite have already been submitted to the Commission and are included herein by reference. Specifically, the legal information requestedin Section 25.137 and the technical information requested in Section 25.114, including the Schedule S information, for the TerreStar—1 satellite can be found in TMI Communications and Company, Limited Partnership, Letter ofIntent to Provide Mobile—Satellite Service in the 2 GHz Bands, File Nos. SAT—LOI—19970926— 00161 and SAT—AMD—20001103—00158 and TerreStar Networks Inc. Application for Modification ofLeiter ofIntent Authorization, File.No. SAT—MOD—20070529—00075. To the extent necessary, however, PanAmSatrespectfully requests a waiver of the need to provide additional technical information under Section 25.114 of the Commission‘s rules for its pro2posed LEOP services.‘ The Commission may grant a waiver for good cause shown." The Commission typically grants a waiver where the pamcular facts make strict compliance inconsistent with the public interest." In granting a waiver, the Commission may take into account considerations of hardshlp, equ1ty, or more effective implementation of overall policy on an individual basis.* Waiver is therefore appropriate if special circumstances warrant a deviation from the general rule, and such a deviation will serve the public interest. In this case, good cause exists for a waiver of Section 25.114. PanAmSat has provided in this STA request the technical information that is relevant to the LEOP services for which PanAmSat seeks authorization. The remainder of the information sought bySection 25.114 is not required to determine potential harmful interference because PanAmSat will perform the LEOP services on a non—interference basis. Nor is it required to protect adjacent satellites because, as noted in the STA request, the LEOP services have been coordinated with operators with co—frequency satellites that are in the LEOP path. In the special circumstance of LEOP services, waiver of the need to provide additional technical information under Section 25.114 serves the public interest. ‘A7 C.F.R. §25.114. «2 47 C.F.R. §1.3. * N.E.
