     MOTION TDESIGNATE PROCEEDINGS AS «PERMIT—BUT—DISCLOSE®
       Mobile Satellite Ventures Subsidiary LLC (*MSV") hereby requests that the Commission
designate the exparte status of the above—captioned proceeding as "permit—but—disclose.""
Pursuant to the Commission‘s rules, "[wJhere the public interest so requires in a particular
proceeding, the Commission and its staffretain the discretion to modify the applicable exparte
ules by order, letter, or public notice." 47 C.FR. § 1.1200(a). This proceeding involves an
application to operate an earth station in the United States using an uncoordinated Inmarsat
satellte in the L band. The application raises policyissues concerning the management of L
band spectrum, including complex technical issues, which are the same issues raised by similar
previously filed applications currently pending before the International Bureau to operate with an
uncoordinated Inmarsat satellite.* The International Bureau has already designated these
