Koch Pipeline Company LP FCC Form 312-R Exhibit A August 2010 Exhibit A Request for Waiver of Section 25.121(e) of the FCC’s Rules Koch Pipeline Company, L.P. (“Koch”) respectfully requests a waiver of Section 25.121(e) of the Commission’s rules in processing Koch’s renewal applications for its two fixed satellite service authorizations (Call Signs E900554 and E900556). Section 25.121(e) of the rules requires that renewal applications for earth station licenses be filed no later than 30 days before the expiration of the license. Due to a clerical oversight, Koch is submitting these renewal applications less than 30 days prior to the license expiration. Under Section 1.3 of the Rules, the Commission may waive its requirements if good cause is shown. Koch submits that waiver of Section 25.121(e) of the rules is appropriate here as dismissal of Koch’s renewal application and non-renewal of its satellite authorizations would be a disproportionate response to slightly late-filed applications that are being submitted before the license expiration. In addition, grant of the requested waiver would be in the public interest, as strict application of the Section 25.121(e) would be unduly burdensome and contrary to past International Bureau practice.
