Response to FCC Form 312, Question 42a USE OF NON—U.S. LICENSED SATELLITES Page 1 of 1 INFORMATION ON USE OF NON—U.S. LICENSED SATELLITES Globalstar USA currently has a pending application to modify its mobile earth station ("MES") blanket license to permit communications with Globalstar, Inc.‘s ("Globalstar‘s") second—generation MSS satellites (both those already launched and those to be launched), which are licensed through the Republic of France. See Application for Modification of Mobile Satellite Service Earth Station Licenses and Mobile Earth Terminal Licenses to Authorize Communications with Second— Generation System and to Incorporate Previously—Granted Ancillary Terrestrial Component Authority, Globalstar Licensee LLC, GUSA Licensee LLC, and GCL Licensee LLC, IBFS File No. SES—MFS—20091221—01602 (Dec. 21, 2009); Application for Modification of Nongeostationary Mobile Satellite Service System License (82115) to Launch a Second—Generation System, IBFS File Nos. SAT—MOD—20080904—00165, SAT—AMD—20091221—00147 (Dec. 21, 2009) ("Second— Generation Application"). The instant application for modification should be processed separately from Globalstar USA‘s Second—Generation Application, and should have no effect on the Federal Communications Commission‘s ("Commission‘s") treatment of that application. In the instant modification request, Globalstar USA lists Globalstatr‘s French—licensed second— generation MSS satellites as "Points of Communication" for the additional and modified MES units proposed herein (see FCC Form 312, Schedule B). Globalstar USA fully understands, however, that communications between these proposed MES units and the second—generation MSS satellites can be initiated in the U.S. (including all territories, possessions, and territorial waters) only after the Commission has granted 50# the instant request for modification and the Second—Generation Application. In the event the Commission approves the instant modification request before the Second—Generation Application, the proposed additional and modified MES units will in the U.S. communicate o#/y with Globalstar‘s U.S.—licensed first—generation satellites until such time as the Commission grants the Second—Generation Application. In the Second—Generation Application, Globalstar certified that, for purposes of the effective competitive opportunities showing otherwise required under section 25.137 of the Commission‘s rules (47 C.F.R. § 25.137), Globalstar‘s second—generation satellites are licensed by France, which is a member of the World Trade Organization, and will be used for services covered under the World Trade Organization Basic Telecommunications Agreement. Accordingly, no showing relating to section 25.137 was required in connection with the Second—Generation Application, nor is such showing required in the instant application for modification.
