Washington, DC 20054 Re: HNS License Sub, LLC File No. SES—MOD—20090518—00601, Call Sign EQ40382 Dear Ms. Dortch: HNS License Sub, LLC ("Hughes"), licensee of the above—referenced earth station in New York City, NY, by its attorneys, hereby requests an additional 12 months to meet the construction deadline for the earth station. The modification application was granted on October 14, 2009. The conditions in Section H of the modified authorization include the obligation to complete construction by the "required date of completion" unless an extension is requested and supported. Under Section 25.133(b) of the Commission‘s rules, the required date of completion for the modified facility was October 14, 2010. Hughes continues to be unable to secure the requisite construction/installation approvals from the owner of the property on which the antenna is to be sited, and this inability is a matter beyond Hughes‘s control. Hughes emphasizes that it is prepared to proceed promptly with the installation once approval is obtained. This is not a zoning issue.
