Exhibit B Page 1 of 2 University of Northwestern-St. Paul Application for new license for 2.4m Ku Earth Station The University of Northwestern-St. Paul proposes to license a 2.4m Ku T/R earth station on the roof of the Mel Johnson Media Center building owned by the University. The height above ground of the roof of the building is approximately thirty (30’) feet (9.14m). As can be seen by the included photos, an elevator penthouse superstructure, an integral part of the building, extends some thirty additional feet above the roof, thus shielding the proposed ES antenna from posing any threat to air navigation. CFR 47 17.14 (a) states that “A notification to the Federal Aviation Administration is not required for any of the following construction or alteration: (a) Any object that would be shielded by existing structures of a permanent and substantial character or by natural terrain or topographic features of equal or greater height, and would be located in the congested area of a city, town, or settlement where it is evident beyond all reasonable doubt that the structure so shielded will not adversely affect safety in air navigation.” The building which supports the proposed antenna is located near the Southwest corner of the intersection of two busy, major streets, Lydia Street and Snelling Avenue of Roseville, Minnesota. Even though the proposed antenna height above ground exceeds the maximum height restriction set forth in CFR 47 17.4 (c), we believe that no notification need be made to the FAA.
