                                                                      FCC FORM 312
                                                                     ATTACHMENT 1

                                             Item 28

TeleBEEPER of New Mexico, Inc. (“TeleBEEPER” or “Applicant”) respectfully
requests a waiver of the requirement to submit a radiation hazard study, to the extent necessary.

The subject application seeks to re-authorize the same equipment, at the same power
levels, that was previously authorized under Call Sign E940533. The only change from that
prior authorization involves the relocation to TeleBEEPER’s current headquarters,
approximately 0.3 miles from the previously-authorized location. Consequently, there is no
change in the potential for human exposure to RF radiation from that previously authorized by
the Commission. Additionally, the requested earth station will be operated at relatively low
power. Moreover, the subject station will be located on TeleBEEPER’s rooftop accessible only
to TeleBEEPER’s technical personnel or contractors who are well aware of the potential for RF
exposure.

For all the foregoing reasons, TeleBEEPER respectfully submits that the inclusion of a
new radiation hazard study with this application is not necessary to ensure that human exposure
to RF is limited as contemplated by the Commission’s rules and policies. TeleBEEPER
therefore respectfully requests that the Commission waive the requirement to include such a
study.
