SWE—DISH Satellite Systems



Dear Sir:

The purpose of this letter is to state the basis of SWE—DISH Satellite Systems (SWE—DISH)
request to the FCC for authority, as an uplink operator to operate 0.90 meter by .66 meter Ku—
Band antennas which are non—compliant with FCC rule 47 CFR 25.209 (a) and (b); specifically,
the SWE—DISH fixed satellite IPT Suitcase System ("The Antenna") from within the Continental
United States (CONUS). The antenna will be accessing International and Domestic satellites
between 15 — 143 degrees West Longitude where satellites in the SES Americom, Inc., fleet
could potentially be adjacent with respect to 2 degree spacing issues.

The SWE—DISH proposed operations are as follows:
Antenna:             0.90 meter by .66 meter SWE—DISH IPS Suitcase System
Frequency Band:      14.0 — 14.5 GHz
Maximum RF Power: —16.0 dBW/4kHz
Emission Designator: 64 kbps to 2048 kbps, QPSK, typical & FEC Data
Satellite:           15W.L. to 143 W.L.

SES Americom, Inc. has evaluated the planned operations using the Antenna and has determined
that such operations will not cause harmful interference to any lawfully operated radio station or
satellite within 2 degrees. SES Americom, Inc. agrees that:

        (a)   In the event SES Americom, Inc. is informed of, or determines, the existence of
              harmful interference from the use of the Antenna, SWE—DISH will immediately
              cease operations that SES Americom, Inc. believes are the cause of such
              interference.

         (b)        Any actions and/or expense necessary to modify SWE—DISH‘s operations in order
                    to rectify interference associated with use of the Antenna shall be the sole
                    responsibility of SWE—DISH.

         (c)        No act or omission of SWE—DISH shall in any way limit or waive the rights and
                    obligations SWE—DISH has under law or as an FCC licensee nor shall it limit or
                    waive the service responsibilities of SWE—DISH or the obligations of SWE—DISH
                    to avoid or mitigate harmful interference.

In the event of any dispute regarding interference into the Antenna that SWE—DISH may have
with another satellite operator, or customer of another satellite operator, SWE—DISH will meet
with the other satellite operator, and, if necessary, the FCC, in order to attempt to resolve the
dispute.
