Dear Mr. Mitchell,

We are modifying and reissuing our earlier request for additional information, as follows:

In order to complete the review of your application for operation on vessels in the Ku Band we
require the following information within 30 days of the date of this letter. Failure to do so may
result in dismissal of the application:

       Points of Communication
       Identification of specific points of communication by satellite name and by orbital
       location. Any number of points of communication may be identified. Use of ALSAT is
       not acceptable for the type of operation for which you are seeking authorization.

       Pointing, Accuracy
       A statement attesting that the maximum pointing error is within 0.2 degrees, under all
       operating conditions, with supporting data.

       Mutinn
       Please clarify that emissions will cease if a correction of more than 0.5 degrees in the
       pointing direction of the antenna is required to maintain lock on the satellite. You should
       respond to this question by preparing an engineering showing that provides compelling
       evidence that the antenna tracking, pointing and control system will cause transmissions
       to cease if pointing error exceeds 0.50 degrees and not resume until pointing error is
       within 0.20 degrees.

       Affidavits
       Please either:
       Provide an affidavit or declaration from the operator of each satellite adjacent to and
       within six degrees of the points of communication identified by the applicant, attesting or

                   declaring that each such operator IS aware of and acknowledges the applicant’s proposed
                   operation in the Ku Band, and does not object to that operation.

                   or take the following actions:
                   1. Prepare an interference analysis for the earth stations and the antennas for which you
                   are seeking authorization that shows that the proposed operations are compatible with
                   adjacent satellite operations, and serve a copy of this analysis on operators of potentially
                   affected satellites adjacent to and within six degrees of the satellite providing space
                   segment services to the ESV applicant, under cover of a notice;

                   2. In the cover notice, notify potentially affected adjacent operators of your understanding
                   that your proposed operation will be consistent with the satellite system coordination
                   agreements between your segment provider and such adjacent satellite operators;

                   3. In the cover notice, clearly notify the recipient that the recipient’s failure to reply
                   within 30 calendar days from the date of notice will be construed as assent to the grant of
                   the applicant’s ESV earth station application;

                   4. File the correspondence prepared in accord with 1-3 above as a supplement to the
                   application already on file, so that the Commission may place the supplement filing on
                   public notice for a period of 30 days.

                   24 Hour Contact
                   The name and telephone number of a contact person in the United States, available seven
                   days a week, twenty-four hours a day, for cessation of emissions from suspected source
                   of interference in the event of need to resolve interference issues, on direction from
                   authority with jurisdiction for licensing in the area of operation.

                   Subiect to Outcome of Rule Making
                   Acknowledgement that any license will be subject to the outcome of any Rule Making.

            We note that applicant has petitioned for appropriate waiver of 2.106 for non-conforming use of
            FSS frequency bands for an ESV application.

            Please file your response, in accord with Part 1 of the Commission’s rules, with Marlene H.
            Dortch, Secretary, Federal Communications Commission, 445 12th Street, S.W., Washington,
            DC 20554 and copy me.
