       MOTION To DESIGNATE PROCEEDINGS AS «PERMIT—BUT—DISCLOSE®
        Mobile Satellite Ventures Subsidiary LLC (‘MSV) hereby requests that the Commission
 designate the exparte status ofthe above—captioned proceedings as "permit—but—disclose.""
 Pursuantto the Commission‘s rules, "w]here the public interest so requires in a particular
 proceeding, the Commission and its staffretain the discretion to modify the applicable ex parte
 rules by order,letter,or public notice."" 47 C.FR. § 1.1200(a). These proceedings involve
 applications to operate earth stations in the United States using an uncoordinated Inmarsat
 satellitein the L band. The applications raise policy issues concemning the management of L
 band spectrum, including complex technical issues, which are similar to issues raised by similar
 previously filed applications currently pending before the International Bureau to operate with an
 uncoordinated Inmarsat satelite." The International Bureau has already designated these

On May30, 2006, the Satellite Division granted Mobile Satellte Ventures Subsidiary
LLC‘s request to designate Thrane & Thrane Airtime Ltd. ("Thrane & Thrane") earth
station applications that seek authority and special temporary authority to provide Mobile
Satellte Services in the L—band with Inmarsat‘s 4F2 satellite,to be located at 52.75°
W.L, as "permit—but—disclose"for purposes ofthe Commission‘s rules govering ex
parte communications. See Motion to Designate Proceeding as «Permit—But—Disclose,"
filed by Mobile Satellte Ventures Subsidiary LLC on May 23, 2006. We find that
designating these Thrane & Thrane applications as "permit—but—disclose" will facilitate
resolution ofthe complex policy issues raised by the applications. Thus, we designate
IBFS File Nos.SES—LFS—20060522—00852 and SES—STA—20060522—00857 as "permit«
but—disclose," effective May 30, 2006. See 47 C.F.R. §§ 1.1200(a), 1.1206 and 1.1208
note 2. This action is without prejudice to any determination regarding the processing of
the appliation.
