Attachment 3, page 4, § IIILD of the amended version of the above—referenced application discusses issues concerning national security, law enforcement and public safety concerns. This part of the application simply restated information that was provided in the original November, 2005 application submitted by affiliate and predecessor applicant, MVS USA, Inc. ("MVS USA" — SES—LFS— 20051123—01634). (MVS Fed and MVS USA are commonly controlled by Debcom, Inc., and the amended application reflects a pro forma reorganization of their respective operations.) The information in MVS USA‘s application was proffered pursuant to its understanding at the time that then—existing arrangements between U.S. government agencies and underlying network providers for BGAN service were sufficient to cover MVS USA‘s operations for such purposes. This letter is intended to clarify and reaffirm the current understanding of MVS USA, MVS Fed and their common owner, Debcom, Inc. that a separate NSA and IP will be entered into for the applicant, which is now MV S Fed. Subsequent to the filing ofits original application, MVS USA entered into discussions with relevant U.S. government personnel regarding a network security agreement ("NSA") and accompanying implementation plan ("IP") specific to MVS USA. MVS Fed, as the successor applicant to MVS USA, remains in discussions with U.S. government personnel to enter into an
