Dear Ms. Dortch:
         New I C 0 Satellite Services, G.P. (“ICO”) hereby requests that the International
Bureau modify the ex parte status of the above-referenced proceeding from restricted to
permit-but-disclose, pursuant to Sections l.l200(a) and 1.1208 of the Commission’s
rules. I Grant of this request will permit IC0 and other interested parties to communicate
directly with the Commission and its staff, subject to applicable public disclosure
requirements.

       This proceeding involves an application (“Application”) filed by ICO, seeking a
blanket license for mobile earth terminals and ancillary terrestrial component facilities to
be used in conjunction with ICO’s 2 GHz mobile satellite service system. Petitions to
deny and comments were filed in response to the Application.*

       For ex parte purposes, this proceeding is a “restricted” proceeding under Section
1.1208.3 The Commission, however, has the authority to modify the exparte status of a
proceeding “[ wlhere the public interest so require^."^ The Commission routinely has
redesignated the ex parte status of a proceeding as “permit-but-disclose” where complex

The request of New IC0 Satellite Services, G.P. (ICO) to designate the proceeding
pertaining to its request to operate Ancillary Terrestrial Component (ATC) base stations
and dual-mode Mobile Satellite Service (MSS)/ATC mobile terminals in spectrum
reserved for provision of 2 GHz MSS in the United States via a United Kingdom-licensed
satellite as “permit-but-disclose” for purposes of the Commission’s rules governing ex
parte communications IS GRANTED. Letter from Suzanne Hutchings Malloy, Senior
V.P., Regulatory Affairs, New IC0 Satellite Services, G.G., to Marlene H. Dortch,
Secretary, Federal Communications Commission, dated May 13, 2008. IC0 stated in its
letter that it has contacted all other parties to the proceeding and none opposes the change
in status. We find that designating this proceeding as “permit-but-dis~lose~~  will facilitate
resolution of the complex policy issues raised here. We therefore designate the
proceeding as “permit-but-disclose,” effective May 20, 2008. See 47 C.F.R. $5
1.12OO(a), 1.1206 and 1.1208 note 2. This action is without prejudice to any
determination regarding the processing of the applications.

interest by facilitating communications with Commission staff to address complex
technical, legal, and policy issues raised in this proceeding. Moreover, I C 0 has
contacted all other parties to this proceeding, and none opposes the requested change.
