The TPE Consortium hereby updates this application to reflect a recent pro forma assignment of China Network Communications Group Corporation‘s ("China Netcom") interest in the cable to China United Network Communications Group Company Limited (formerly known as China United Telecommunications Corporation) ("China Unicom"), as described in a proforma assignment notification filed yesterday(see File No. SCL—ASG—20090204—00001). The pro forma assignment occurred as part of a restructuring that took place on January 6, 2009 (retroactively effective as of January 1, 2009). Because China Unicom and China Netcom were both owned and controlled by the government of the People‘s Republic of China — which remains China Unicom‘s ultimate parent — the restructuring did not change the ultimate ownership or control of the license interests and the assignment is thus pro forma in nature.
