Ord. No. 10530 reprinted as amended in 3 U.S.C. § 301, and section 1.767 of the Commission’s rules, 47 C.F.R. § 1.767, the following application IS GRANTED. This grant of authority is taken under section 0.261 of the Commission’s rules, 47 C.F.R. § 0.261, and is effective upon release of this public notice. Petitions for reconsideration under section 1.106 or applications for review under section 1.115 of the Commission’s rules, 47 C.F.R. §§ 1.106, 1.115, may be filed within 30 days of the date of this public notice. This public notice serves as each cable landing licensee’s Cable Landing License, or modification thereto, pursuant to the Cable Landing License Act and sections 1.767 and 1.768 of the Commission’s rules. Cable landing licensees should review carefully the terms and conditions of their licenses. Failure to comply with these terms and conditions or relevant Commission rules and policies could result in fines or forfeitures. The Commission most recently amended its rules applicable to submarine cable landing licenses in Review of Commission Consideration of Applications under the Cable Landing License Act, IB Docket No. 00-106, FCC 01-332 (rel. SUBMARINE CABLE LANDING LICENSE Action Taken: Grant of Cable Landing License to land and operate a fiber-optic submarine cable system, the Sandwich Isles Fiber-Optic Cable (“SIFOC”), extending among the Hawaiian Islands of Kauai, Oahu, Molokai, Maui and Hawaii. See Application for Cable Landing License, File No. SCL-LIC-20040310- 00007 (“Application”). Acceptability for Filing Public Notice: See Sandwich Isles Communications, Inc., Application for a License to Land and Operate a High Capacity Fiber-Optic Cable System within the United States, for the Sandwich Isles Fiber-Optic Cable System, File No. SCL-LIC-20040310-00007, Public Notice, Streamlined Submarine Cable Landing License Applications Accepted for Filing, DA 04-1334 (Int’l Bur., May 12, 2004). Conditions and Requirements: Sandwich Isles Communications, Inc., SHALL COMPLY with the routine conditions set out in section 1.767(g)(1)-(14) of the Commission’s rules. See 47 C.F.R. § 1.767(g)(1)-(14). Licensee Information: Sandwich Isles Communications, Inc. (“Sandwich Isles”) is a corporation organized under the laws of Hawaii. Sandwich Isles will operate a common-carrier fiber-optic submarine cable system, the Sandwich Isles Fiber-Optic Cable (“SIFOC”), extending among the Hawaiian Islands of Kauai, Oahu, Molokai, Maui and Hawaii. See Application at 2. Interlocking Directorates: Sandwich Isles certifies that it has no interlocking directorate with a foreign carrier. Regulatory Status of Cable: Sandwich Isles proposes to operate on a common-carrier basis. See Application at 2. Cable Design and Capacity: Sandwich Isles proposes to construct and operate approximately 300 miles of fiber-optic submarine cables, divided into four segments connecting seven landing sites to link the five major Hawaiian Islands. The SIFOC system, as proposed, will consist of high capacity, digital fiber-optic submarine cable operating at an OC-48 line rate. The system will provide a capacity of 2.5 Gbps, which equates to an initial configuration of approximately 48 DS-3 or 1344 DS-1 channels. Initial engineering will provide OC-3 drop capacity between Kauai and Oahu and OC-12 drop capacity on each of the remaining routes. See Application at 3. The four landing points proposed on Molokai, Maui, and Hawaii are adjacent to existing or future Sandwich Isles terrestrial cables running within the rights-of-way of the nearest roadway. The three proposed landing sites on Kauai and Oahu, sections of underground fiber-optic cable ranging from 1,800 to 17,200 feet, will be installed to connect the landing site to the closest approach of the Applicant’s terrestrial network. At all seven sites, the submarine cable will be connected directly to Sandwich Isles’ terrestrial network at a beach manhole.
