Washington, DC 20554 PHILADELPHIA wew york Re: Request for Special Temporary Authority Los ancBLes SAN FRANCISCO Dear Ms. De La Torre: CBicaso PRINCETON Open Range Communications Inc. hereby requests Special Temporary Authority (STA) PLORRAM PARK to continue operating Ancillary Terrestrial Component (ATC) facilities on spectrum Berwin licensed to Globalstar Licensee LLC.‘ Open Range presently operates on the Globalstar WILMINGTON ATC spectrum pursuant to a Spectrum Manager Lease Agreement. * On December 14, 2009, Globalstar Licensee LLC filed a request for extension of the deadlines by which it must come into compliance with certain of the ATC gating criteria." Under one of the Globalstar conditions, Globalstar must meet the coverage and spare satellite requirements of the FCC‘s ATC rules by July 1, 2010 or else cease operation of any ATC facilities." The July 1" deadline is rapidly approaching and Globalstar has not yet received favorable action on its application. Immediate loss of the Globalstar ATC spectrum would spell the death knell of the Open Range deployment and deprive millions of rural Americans of the opportunity to subscribe to the Open range broadband service. Out of an abundance of caution, and to safeguard its existing operations, as well as the ongoing deployment ofits rural broadband network, Open Range seeks special temporary authority for a period of 18 months® to continue operating on the Globalstar spectrum. Background Open Range is a broadband wireless (WiMAX) service provider. Its primary mission is to deliver wireless broadband and voice services to communities in rural America. Open Range was formed in 2004 with a vision to build an advanced wireless network that will close the broadband gap between the rural and urban areas of the country. As the network becomes available in rural communities, the services it provides will be more flexible, less expensive and easier to use than the services now available in many urban areas. In Phase I of the Open Range deployment, which is underway now, the WiMAX network will be extended to cover more than six million people in 555 rural communities. For the first time rural residents in small towns will have the same opportunities for communication, web browsing and connectivity enjoyed by those living in larger American cities. The Open Range plan represents the effectuation in these rural communities of the ambitious objectives set forth by the FCC in its recently released National Broadband Plan. As the Plan states: Broadband is the great infrastructure of the early 21° century. Like electricity a century ago, broadband is a foundation for economic growth, job creation, global competitiveness and a better way of life. It is enabling entire new industries and unlocking vast new possibilities for existing ones. It is changing how we educate children, deliver health care, manage energy, ensure public safety, engage government, and access, organize and disseminate knowledge‘ (Continued) required to negotiate for new spectrum and accomplish any equipment retuning and/or change outs necessary to operate the system on new spectrum. ® Connecting America: The National Broadband Plan, Report to Congress pursuant to the American Recovery and Reinvestment Act of 2009, Pub.L. DrinkerBiddle&Reath Ms. Mindel De La Torre ' June 25, 2010 Page 3 Open Range will represent the realization of this goal for six million Americans residing in more than 500 rural communities The Open Range Deployment Most of the Open Range network is being built with funding provided by The Department of Agriculture Rural Utilities Service. In March 2008 Open Range was granted a loan for $267,000,000 to build broadband facilities in 518 communities. Open Range will build out an additional 37 communities using its own funds." In October, 2008, the Commission temporarily waived certain FCC rules to permit deployment of the Open Range network." Open Range closed its RUS funding in January 2009 and immediately began preparation for the deployment of its network. In the spring and summer of 2009 Open Range completed arrangements for network backhaul, back office functions, billing systems, network equipment and related facilities that will support the entire network deployment. Service was initiated on September 27, 2009 in the first Open Range markets, Fort Lupton, Colorado, a community of 7,126 persons as well as Frederick, Colorado (population 2590), and Platteville, Colorado (population 2489). Following these initial launches, Open Range deployed service in Milliken, Colorado {population 3032), Johnstown, Colorado (population 4018), Mead, Colorado (population 2118), Eaton, Colorado (population 2825), Erie, Colorado (population 6606), Evans, Colorado (population 9990), Greeley, Colorado (population 81,777), Berthoud, Colorado (population 5082), Longmont, Colorado (population 74,648), and Windsor, Colorado (population 10,391). These were the initial test markets in which Open range validated its technology and service concept. The full Open Range deployment schedule is attached as Exhibit 1.‘ ® Open Range funds will be used to build facilities in regional centers located in the rural areasit will serve. ° Globalstar Licensee LLC, Application for Modification ofLicensefor Operation ofAncillary Terrestrial Component Facilities, Order and Authorization, 23 FCC Red 15975 (2008) ("Globalstar Order"). ‘ In 2010, the Open Range plan provides for the deployment of service in 261 markets covering 3,819,758 persons in the states of Alabama, Arkansas, California, Colorado, Delaware, Georgia, IIlinois, Indiana, New Jersey, Ohio, Pennsylvania, South Carolina, and Wisconsin. In 2011, the plan provides for extending the network to an additional 57 communities covering 436,549 persons in the states of Alabama, Arkansas, California, Florida, Georgia, Illinois, Nebraska, New Jersey, Nevada, Ohio, and Wisconsin. In 2012 the plan provides for extending the network to an additional 92 markets covering 656,809 persons in the states of Alabama, Arkansas, California, Colorado, Delaware, Florida, Georgia, Illinois, Indiana, Nebraska, New Jersey, Nevada, Ohio, Pennsylvania, South Carolina, and Wisconsin. In 2013, the plan provides for extending the network to 114 markets covering 554,757 persons in the states of Alabama, Arkansas, California, Colorado, Florida, Georgia, Illinois, Indiana, Nevada, Ohio, Pennsylvania, and Wisconsin. And in 2014, the Phase I build out plan concludes with the extension of the network to 25 communities and 680,992 persons in the states of California, New Jersey, and New York. For example, a former dial—up customer who is a member of the Red Hat Society uses the Internet to order her dress for the Red Hat gala each year. When her Open Range service was installed, she was amazed at how fast she could download the J.C. Penny website. Another former dial—up customer said "I love my Open Range service. It is as simple as you said it would be. I plugged it in and I was up and running". A customer who had no Internet service at all said "I was using my neighbor‘s [dial—up] Internet. I was always being kicked off. I needed Internet, but was afraid of the price. I can‘t believe I am only paying $59.45 for unlimited local calls and Internet. Compare this to my cell phone bill, which is $75.00 per month". Another said "I am saving approximately $100 per month! Activating service was the simplest thing I‘ve ever done; I just plugged it in and everything worked. And Justin on the customer service team went out of his way to set everything up. I don‘t use a credit card or bank account, and he researched the best option for a pre—paid credit card and called me with all the details". Commenting on the speed of the service another customer said "Now I don‘t have to open an Internet page, make dinner, and come back so see if my Internet page is downloaded. My Open Range service is instantaneous". Commenting on the Open Range customer service team, another said "I‘ve been a customer since 2009. I switched because I was tired of the hassles with my previous provider and getting stuck in an automated phone tree when I called for help. When I call Open Range, an actual person answers the phone! Activation was simple and I‘m very happy with my service". These are a few of the many positive responses received by Open Range so far. Clearly, the deployment of the Open Range network is making a difference in the lives of these rural Americans. The Globalstar Spectrum The spectrum supporting the Open Range WiMAX deployment is available to Open Range under a Spectrum Manager Lease with Globalstar Licensee LLC."‘ The lease provides Open Range the right to deploy its services in rural areas of the United States covering up to 50 million people. The availability of this spectrum is critical to the Open Range deployment because it is available nationwide and may be used in very small communities without the need to obtain separate local FCC licensing. If Open Range (Continued) Open Range is seeking additional funding under the American Reinvestment and Recovery Act to extend service to an additional 177 markets and 1.9 million persons. Finally, Open Range is reviewing additional rural markets for the deployment ofits WiMAX network and is also seeking to work with affiliates to deploy broadband services in other rural markets throughout the United States. ‘‘ See Globalstar Order, supra at §24—27.

Drinkchiddlc&Bqaltl} Ms. Mindel De La Torre June 25, 2010 Page 5 were required to obtain individual FCC licenses or other means of access to the spectrum in each of the small communities it seeks to serve, its plan could be infeasible." In most instances, the markets Open Range seeks to serve encompass small rural communities that are far smaller than the smallest area—type license awarded by the FCC. Negotiating to acquire disaggregated spectrum or to lease spectrum from larger, established carriers in more than 500 rural communities would be an extremely difficult task that could substantially delay the roll out of service in many rural communities." A Grant of Special Temporary Authority is Essential to The Open Range Deployment Open Range is at a critical juncture in the deployment ofits rural broadband network. The initial Open Range test markets turned up in September, 2009. Following the successful completion of the testing phase, Open Range began regular deployment ofits network. Open Range has proceeded to turn up rural markets and by the end of June its network will reach more than 500,000 rural residents. Likewise as of the end of June, Open Range will have positioned resources in 8 of the 17 states that its network will eventually reach. With those resources in place, the Open Range deployment will accelerate significantly because construction activities will proceed in these areas in parallel. Over the next two months, initial markets will be turned up in 5 additional states. Thus, by the end of August, only two months hence, the Open Range network will reach a population of approximately 3 million residents in 13 of the 17 Open Range states. At that time, the Phase I deployment, which is intended to cover a population of more than 6 million people, will be approximately half—way to completion. During calendar year 2010 alone Open Range will invest more than $119 million in expanding rural broadband service. Loss of the Globalstar spectrum on July 1st would not only deprive 500,000 rural residents of the opportunity to subscribe to the Open Range service, but it would halt the rapidly escalating deployment of that service to 2.5 million more people by the end of August. Loss of the spectrum would also cause the Rural Utilities Service, which is funding the deployment, to cease making advances to Open Range and could place Open Range in default of its loan agreement. This would spell the death knell of Open Range as an entity and disrupt the largest rural broadband deployment ever attempted. * This problem was noted in the Commission National Broadband Plan (see Recommendation 5.7). " The Commission specifically noted the importance of MSS ATC spectrum in achieving the goals of the National Broadband Plan (See Recommendation 5.8.4)

DrinkerBiddle&Reath Ms. Mindel De La Torre June 25, 2010 Page 6 Beyond the immediate effects on Open Range and its customers, as well as those who Open Range intends to serve, failure of the Open Range plan would serve as a chilling reminder to others who seek to carry out ambitious rural deployments that those deployments are likely too risky to undertake. From the beginning, Open Range has seen its role as serving rural America. This is in sharp contrast to the deployment plans of . ? most larger service providers. Generally speaking, due to the density—driven economics of providing service, large providers roll out their service in the densest markets first. As these providers deploy to less and less dense areas, the economics of deployment begin to create an incentive to stop the deployment before it reaches the least served areas of the country. Open Range, on the other hand, has targeted these unserved and underserved areas. Using a combination of Rural Utilities Service financing and an innovative service plan designed to overcome many of the economic barriers in rural America, Open Range has created a viable way to make this service possible. One of the fundamental economic drivers making the deployment possible has been Open Range‘s ability to use a uniform ATC spectrum band throughout the country without the need to negotiate individual spectrum rights (through disaggregation of existing licenses or leasing) in each small marketit seeks to serve. If Open Range stands to lose access to | the Globalstar ATC spectrum, it will require significant time to secure alternative spectrum rights market—by—market. To avoid halting the largest rural broadband deployment ever attempted, Open Range respectfully requests that the Commission provide sufficient time so that Open Range may explore alternative spectrum arrangements if the Globalstar extension request is not to be approved. Wherefore Open Range Communications Inc. respectfully requests that the Commission grant special temporary authority for Open Range to continue using the Globalstar ATC spectrum for a period of 18 months commencing July 1, 2010.
