The request of Intelsat North America, LLC (Intelsat) for special temporary authority (STA), File No.
SAT—STA—20091216—00146, is granted. Accordingly, Intelsat is authorized, for a period of 60 days
commencing on February 22, 2010, to drift the C— and Ku—band Intelsat 801 space station (Call Sign
$2391) from the 31.5° W.L. orbital location to the 29.5° W.L. orbital location and to operate temporarily
the Fixed—Satellite Service (FSS) communications payloads during the drift and while at the 29.5 ° W.L.
orbital location. Specifically, Intelsat is authorized to use the following telemetry, tracking, and
telecommand (TT&C) frequency bands for these operations: 3947.5 MHz (RHCP), 3948.0 MHz (RHCP),
3952.0 (RHCP), and 3952.5 MHz (RHCP) (space—to—Earth); 6173.7 MHz (LHCP) and 6176.3 MHz
(RHCP) (Earth—to—space). During the drift, Intelsat is authorized to operate the C—band communications
payload on the Intelsat 801 space station in the 3625—4200 MHz (space—to—Earth) and 5850—6425 MHz
(Earth—to—space) frequency bands in order to ensure continuity of service to existing customers. After
completion of drift, Intelsat is authorized to operate the FSS C— and Ku—band communications payload on
the Intelsat 801 space station at the 29.5 ° W.L. orbital location temporarily in the following frequency
bands: 3625—4200 MHz (space—to—Earth), 5850—6425 MHz (Earth—to—space), 10.95—11.2 GHz (space—to—
Earth), 11.45—11.95 GHz (space—to—Earth), 12.5—12.75 GHz (space—to—Earth), and 14.0—14.5 GHz (Earth—
to—space). This authorization is granted in accordance with the terms, conditions, and technical
specifications set forth in Intelsat‘s application, the Federal Communication Commission‘s rules, and the
conditions of this attachment.

    1.   All operations shall be on an unprotected and non—harmful interference basis, i.e., Intelsat
         shall not cause harmful interference to, and shall not claim protection from interference caused
         to it by, any other lawfully operating radiocommunication system.

    2.   In the event of any harmful interference as a result of the operations of Intelsat 801 at the 29.5°
         W.L. orbit location or during drift to the 29.5° W.L. orbital location, Intelsat shall cease
         operations immediately upon notification of such interference and shall inform the Commission,
         in writing, immediately of such an event.

    3.   Intelsat shall coordinate its operations with existing geostationary satellites to ensure that no
         unacceptable interference results from its temporary operations at the 29.5° W .L. orbital location
         or from its TT&C operations during the drift to the 29.5° W.L. orbital location.

    4.    Intelsat shall operate the Intelsat 801 space station at the 29.5° W.L. orbital location in
         compliance with all existing or future coordination agreements for that location.

    5.   Intelsat does not seek — and is not authorized — to operate the Intelsat 801 space station‘s
         extended C—band (i.e., 3625—3700 MHz and 5850—5925 MHz) or extended Ku—band (i.e., 10.95—
         11.2 GHz and 11.45—11.7 GHz) frequencies to, from, or within the United States under this
         authorization.

    6.   Use of the 12.5—12.75 GHz frequency bands is not permitted for Fixed—Satellite Service in the
         space—to—Earth direction in Region 2.

    7.   Grant of this authorization is without prejudice to any determination that the Commission may
         make regarding Intelsat‘s pending application for permanent operations of the Intelsat 801 space
         station at the 29.5° W.L. orbital location (IBFS File No. SAT—MOD—20100208—00024)

8. Any action taken or expense incurred as a result of operations pursuant to this STA is at Intelsat‘s
    own risk.

    Intelsat is afforded 30 days from the date of release of this grant and authorization to decline this
    authorization as conditioned. Failure to respond within this period will constitute formal
    acceptance of the authorization as conditioned.

10. This action is issued pursuant to Section 0.261 of the Commission‘s rules on delegated authority,
    47 C.F.R. § 0.261, and is effective immediately. Petitions for reconsideration under Section
    1.106 or applications for review under Section 1.115 of the Commission‘s rules, 47 C.F.R. §§
    1.106, 1.115, may be filed within 30 days of the date of the public notice indicating that this
    action was taken.

Intelsat North America LLC herein requests Special Temporary Authority for 60 days beginning
February 15,        2010 to drift Intelsat 801 from 31.5 W.L.   to 29.5 W.L. and operate temporarily at the
29.5 W.L.        location.   Intelsat plans shortly to file an application to modify the license for
Intelsat 801 to allow its permanent operation at that location, where it will be co—located with
Intelsat 705.

    Dear Ms. Dortch:

    Intelsat North Amenca LLC ("Intelsat") herein requests Special Temporary
    Authority ("STA") for 60 days beginning February 15, 2010 to drift Intelsat
    801 from 31.5° W.L. to 29.5° W.L. and operate temporarily at the 29.5° W.L.
    location." Intelsat plans shortly to file an application to modify the license for
    Intelsat 801 to allow its permanent operation at that location, where it will be
    co—located with Intelsat705.

      Intelsat expects to have Intelsat 801 at 29.5° W.L. mid — to late March 2010.
      During the drift, Intelsat will continue operating the satellite‘s C—band
      communications frequencies, as well as the satellite‘s TT&C frequencies. The
      operation of the satellite‘s C—band communications frequencies during the drift
      is being done to ensure continuity of service to C—band customers on the
      satellite —— including a U.S. Government customer —— that cannot be
      accommodated on another Intelsat satellite until a later date.* Intelsat
    . confirms that there are no satellites between 31.5° W.L. and 29.5° W.L. that
      operate a C—band communications payload. The specific C—band
      communications frequencies that will be operating durmg the drift are as
      follows:

    Uplink:
     3625—4200 MHz

     ‘ Intelsat has filed this STA request, an FCC Form 159 and an $830.00 filing
    fee electronically via the International Buréau‘s Filing System.
    * Intelsat 801 cannot remain at the nominal 31.5° W.L. location and possibly
    transfer its traffic to Intelsat 25, which will operate at 31.5° W.L. subject to
    receipt of FCC approval because Intelsat 25 is a linearly polarized satellite,
    while Intelsat 801 is circularly polarized.
    * Subject to receipt of FCC approval, Intelsat 705 will be relocated from 5 0 0°
    W.L. to 29.5° W.L. starting mid—February 2010.
    * Intelsat 705 will be at full capacity with 2010 World Cup—related
    transmissions until the sporting event has concluded.

  Downlink:

  5850—6425 MHz

  Intelsat will follow industry ’practices in coordinating the TT&C transmissions _
  that will be used during the drift. The specific TT&C frequencies are as
  follows:.

  Uplink:

  6173.7 MHz (LHCP) and 6176.3 MHz (RHCP)

  Downlink:

  3947.5 MHz (RHCP), 3948.0 MHz (RHCP), 3952.0 MHz (RHCP), and 3952.5

  Once at 29.5° W.L., Intelsat will operate the satellite‘s Ku—band payload as
  well. Specifically, those frequencies are as follows:

  Uplink:

  14.0—14.5 GHe _
  Downlink:

  10.95—11.2 GHz; 11.45—11.95 GHz and 12.5—12.75 GHz." .

  Grant of this STA request is in the public interest becauseit will allow Intelsat
  to ensure continuity of service to C—band customers on Intelsat 801, with no
  service outage while the satellite drifts. Customers will not experience service
  degradation because they will be tracking the satellite during the drift.

  Grant of this STA request will not result in increased risk of harmful
— interference. As noted above, there are no satellites in the drift path utilizing
  C—band communications frequencies and thus, no interference issues are
  foreseen. In any case, should any interference occur during the drift, Intelsat
  will take all reasonable steps to eliminate such interference. At the 29.5° W.L.



  * The 12.5—12.75 GHz frequencies will be used only in ITU Region 1.

location, Intelsat will operate the satellite‘s C— and Ku—band communications
and TT&C frequencies in conformance with its coordination agreements
applicable to operationat this location.

Intelsat has assessed and limited the probability of the space station becoming
a source of debris as a result of collisions with large debris or other operational
space stations. Except for Intelsat 705, Intelsat 801 will not be located at the
same orbital location as another satellite or at an orbital locauon that has an
overlapping station—keeping volume with another satellite." Further, except for
Intelsat 705, Intelsat is not aware of any other FCC licensed system, or any
other system applied for and under consideration by the FCC, having an       _
overlapping station—keeping volume with Intelsat 801 at 29.5° W.L. Finally,
Intelsat is not aware of any satellite network with an overlapping station—
keeping volume with Intelsat 801 that is the subject of an ITU fihng and that is
either in orbit or progressing towards launch.

For the reasons set forth herein, Intelsat respectfully requests that the
Commission grant this request.

                          Intelsat North America LLC ("Intelsat North America"), by counsel, files this letter
                          pursuant to Section 1.65 of the Federal Communications Commission‘s ("FCC")
                          rules‘ to clarify certain frequency information in the above—referenced application
                          for Special Temporary Authority ("STA") to drift the Intelsat 801 satellite (call sign
                          $2391) from 31.5° W.L. to 29.5° W.L. and to operate temporarily at the 29.5° W.L.
                          location.

                          First, the pending STA request inadvertently switched the uplink and downlink C—
                          band frequencies that are proposed for use during the drift. The corrected
                          frequencies are as follows:

                          Uplink: 5850—6425 MHz
                          Downlink: 3625—4200 MHz

                          Second, Intelsat North America clarifies that the pending STA request does not seek
                          authority to operate the Intelsat 801 satellite‘s extended C—band (i.e., 3625—3700
                          MHz and 5850—5925 MHz) or extended Ku—band frequencies (i.e., 10.95—11.2 GHz
                          and 11.45—11.7 GHz) to, from or within the United States. Intelsat 801‘s extended
                          C—band frequencies will be used only outside the United States during the proposed
                          drift and temporary operations at 29.5° W.L. Additionally, Intelsat North America
                          clarifies that the geographic footprint for the beams that utilize the extended Ku—
                          band on Intelsat 801 will not include the United States.
