The request of DIRECTV Enterprises, LLC ("DIRECTV") for special temporary
authority (STA), File No. SAT-STA-20060807-00085, as amended on September 26,
2006,' IS GRANTED. Accordingly, DIRECTV IS AUTHORIZED to locate the
DIRECTV 9s satellite, a hybrid Direct Broadcast Satellite (DBS) and Fixed Satellite
Service (FSS) Ka-band satellite, at the 138" W.L. orbital location to conduct in-orbit
testing of the DIRECTV 9 s DBS space station previously authorized by the Satellite
Division.* Also, DIRECTV IS AUTHORIZED to operate the DIRECTV 9s satellite's
telemetry, tracking and command (TT&C) functions on the 17795 MHz (uplink) and
12695.5 and 12696.5 MHz (downlink) frequencies, for the 52-day period from the date of
launch, including during in-orbit testing at the 138" W.L. orbital location and during
relocation of the satellite to its licensed location at 101. l oW.L. This authorization is
granted in accordance with the terms, conditions, and technical specifications set forth in
DIRECTV's application, this Attachment, and the Commission's rules:

        1. DIRECTV shall notify the Commission in writing of the successful launch of
            DIRECTV 9s within 72 hours after launch.

        2. Testing authority is limited to those frequencies for which the DIRECTV 9s satellite
           is authorized under call sign S2669.

        3. DIRECTV shall coordinate its test operations with all potentially affected lawfully
           operating satellite networks to ensure that no unacceptable interference results from
           its test operations at 138"W.L.

        4. DIRECTV's test operations shall not cause h a d l interference to any lawfully
           operating satellite networks or other radio communications systems and DIRECTV
           9 s shall cease operations immediately upon notification of such interference, and
           DIRECTV shall inform the Commission in writing within three days of such an
           event.

        5 . DIRECTV is required to accept interference from other lawfully operating satellite
            networks or radiocommunication systems.

        6. DIRECTV's operations at 138" W.L. shall be limited solely to in-orbit test operations
           and shall not include the provision of commercial services.

                               7. DIRECTV shall coordinate its TT&C operations with all potentially affected lawfully
                                  operating satellite networks to ensure that no unacceptable interference results from
                                  its TT&C operations at 138" W.L. and during the drift from 138" W.L. to its assigned
                                  orbital location of 101.loW.L.

                               8. DIRECTV shall notify the Commission by email to Chip.Fleming@fcc.p;ov and
                                  Rockie.Patterson@fcc.gov within 48 hours of both the initiation and the completion
                                  of the testing of the satellite at the 138" W.L. orbital location.

                               9. DIRECTV shall notify the Commission in writing no later than seven days after it
                                  has completed testing and moved the DIRECTV 9s satellite to its assigned orbital
                                  location.

                               10. DIRECTV is afforded 30 days from the date of release of this authorization to
                                   decline this authorization as conditioned. Failure to respond within this period will
                                   constitute formal acceptance of the authorization as conditioned.

                               11. This Authority is granted pursuant to Section 0.261 of the Commission's rules on
                                   delegated authority, 47 C.F.R. 5 0.261, and is effective immediately.

Dear Ms. Dortch:

        DIRECTV Enterprises, LLC (“DIRECTV”) hereby requests Special Temporary
Authority (“STA”) to locate the DIRECTV 9s satellite at the 138” W.L. orbital location
for in-orbit testing ((‘IOT”) after launch of the satellite, prior to moving to its assigned
orbital location to begin commercial operations at the nominal 101” W.L. slot.
DIRECTV also requests that this authority cover the use of DBS frequencies for
telemetry, tracking and command (“TT&C”) functions for a period commencing just
prior to reaching 138” W.L. through its migration to 101.1’ W.L. This STA will cover a
period of approximately 40 days, which DIRECTV expects to occur between September
27,2006 and November 6,2006.

       DIRECTV 9s is fully constructed and scheduled for launch in mid-September
2006. DIRECTV desires to commence IOT of the satellite approximately two weeks
after launch, and conclude such testing after approximately two weeks. Specifically,
DIRECTV contemplates the following schedule:

             After launch and orbit raising maneuvers, DIRECTV 9s will be located at
             138” W.L. on or about September 30,2006.

             After DIRECTV 9s reaches 138” W.L., DIRECTV will then commence IOT
             of the satellite from about October 1, 2006 to October 14, 2006.

             After IOT is completed, DIRECTV 9s will then be drifted to its assigned
             location at 101. I ” W.L. over the course of approximately 23 days, reaching
             that orbital position on or about November 6, 2006. During this drift, the

               satellite's communications payload will be turned off other than TT&C
               functions.'

        Operation and testing of DIRECTV 9s during this maneuver will not result in
harmful interference to other satellite systems. As the Commission is aware, 138" W.L.
is a Canadian BSS allocation and is currently unoccupied. DIRECTV has received
permission from Industry Canada for temporary use of the slot for testing, and has
coordinated its IOT plans with Ciel Satellite Communications, Inc., the Canadian DBS
licensee at 129" W.L., which is the nearest DBS system likely to be in operation during
the relevant period. DIRECTV will also coordinate its TT&C operations during drift
with all other potentially affected operators to ensure that no harmful interference results.
DJRECTV successfully coordinated and used this same location for IOT of the
DIRECTV 8 satellite last year.2 Furthermore, DIRECTV is prepared to terminate all
testing operations immediately upon notification from the Commission that its operations
cause harmful interference to any authorized user of the spectrum.

         Grant of this STA request will serve the public interest by allowing DIRECTV to
test the DIRECTV 9s satellite to ensure that it is fully operational and ready to begin
providing service to millions of DIRECTV subscribers fiom the satellite's licensed
orbital location. Allowing DIRECTV to test the satellite at 138" W.L., away from other
operational DBS satellites, will serve the public interest by minimizing the risk of
interference. Accordingly, and in light of the impending launch date, DIRECTV requests
the expeditious grant of special temporary authority.

Dear Ms. Dortch:

        On August 7,2006, DIRECTV Enterprises, LLC (“DIRECTV”) filed the above
reference applications for special temporary authorization (“STA”) to perform in-orbit
testing (“IOT”) of the DIRECTV 9s satellite at 138” W.L. using three Ka-band earth
stations. Those applications were predicated upon a specific timetable, which was based
in turn upon an anticipated launch date in mid-September. Unfortunately, the launch is
now expected on October 12, rendering the previous timetable inoperative.

       Accordingly, and in order to avoid any complications should the launch date slip
hrther, DIRECTV requests that the Commission grant the requested STAs in a way that
is keyed to launch rather than specified dates, as follows:

       Launch + 12 days                        STA begins (initial TT&C)
       Launch + 14 days                        Begin IOT at 138” W.L.
       Launch + 29 days                        Complete IOThegin drift to 101.1O W.L.
       Launch + 52 days                        Drift complete, STA ends

The timetable set forth above covers the same forty-day period as the original
applications, allocating the same period of time to the various activities as did the original

applications. DIRECTV will notify the FCC within three days of successful launch of
DIRECTV 9s in order to set the specific start date for these STAs as defined above.
