EchosStar Satellite L LC.‘s ("EchoStar") requestfor Special Temporary Authority (STA),File
No. SAT—STA—20050321—00068, t relocate the EchoStar 4 stelite from the 157° W.L. orbial
Tocation to the 61.35° WL. orbital location S GRANTED. Accordinaly, EchoStaris authorized
to operate the EchoStr 4 stelite‘s Tracking, Telemetry, Command, and Monitoring (TTC&M)
during the dritto the 61.35° W.L.orbital location for a period of30 days from June 17, 2005,
until July 17, 2005, in accordance with the terms, conditions, and technical specifications set forth
in its application and this Attachment; and
(1) During the dif of the EchoStar 4 satellteto the 61.35° W.L.orbital location, EchoStar shal
not aperate the main communications payload on EchoStar 4
(2) EchoStar shall coordinate ts TTC&M operations with existing geostationary satelites to
ensure that no unacceptable iterference resultsfrom ts TTC&M operations during the drif.
(3) During the drf ofthe satelite to the 61.35° WL. orbital location, no harmful nterference
shall be caused by the EchoSar4 satelite to any other lawfully operating satelites or
radiocommunication systems. Operations ofhe EchaStar 4 satelite shall cease immediately
upon notifation of such interference and EchoStar shall nform the Commission in writing
immediately of such an event.
(4) During the dif of the sateliteto the 61.35° W.L. orbital location, EchoStar 4 is required to
acceptinterference from other lawfully operating in—orbit satelltes.
(5) Any action taken or expense incurred asa result ofoperations pursuanttothis actionis solely
at EchoStar‘s own risk.
(6) EchoStar shall notify the Commission in writing 24 hours prir to the EchoStar 4 arrivalat the
61.35° W.L. orbital location.
(7) Grant ofthis application is withoutprejudiceto action on Echostar‘s June 8,2008 Pettion for
Reconsideration of the EchoStar 4 Order. See Echostar Sateite, LLC, Memorandir Opinion
and Order, DA OS—1581 (rl June 3, 2005) (‘EchoStar 4 Order®). Further, grant ofthi application

Reconsideration in that proceeding, and allow it to relocate th satlite to 77° W.L.® EchoStar
has added totherecord ofthatproceeding significant furthr information about the publi
benefis ofrelocating EchoStar 4 o the 77* W.L. orbta loction. As EchoStar has explaied in
a supplement t ts Petition for Reconsidertion also file today, these benefits include
immediate delivery ofadditional drectto—home (‘DTH") service to Mexican and U.S.
consumers. Further,these benefits can be achieved without harm to any existing EchoStar
custemers beeause theserviceprovided by EchoStar 4 at 157" W.L.is dulicatve of
programming provided by EchoStarat148° W.L. from other satelites in ts Nest. Butthe
Bureau need not evaluatethese benefitsforthe purposes othis request, whichis atEchoSta‘s
own tisk. In the eventthatEchoStar‘s Pettion for Reconsideation is denied, granohis
Applieation is stl in the publc interest because EchoStar 4 will be able to continuc on to the
61.5° W.L. orbiallocation where it wllbeused t augment and/or provide backup for services
ffom EchoStar3, which hasrecenty experienced an addtional trvelingwave tube amplifier
(TWTA®)failure.

        Grant ofthis STA request is in the publicintrest, whether ornot he Bureau ulimately
grants EchoStar‘ Pettin for Reconsideration of the Jme 3 Dental Order. If the Burcau were to

reconsider ts denil ofhe relocation of EchoSuar 4 and allow EchoStar to move the satelite
immeditelyto the 77° W.L.orbital location, the instant STA willhelpto ensure that EchoStar 4

reaches it destination in ime t achieve all of the publi nterest benefits associted with such a
move. These benefit include the delivery oaddtional DTH services to Mexican and U
consumers. Alternatively, even ifthe Bureau were to deny EchoStar‘s Peitionfor
Reconsidention, EchoStar 4 willcontinue on to the 61.5° WLL. orbta loction where it will
augment or rovide backup for theserviceprovided from EchoStar 3, which has recently
experienced an additional TWTA falure
       A. Publlc Interest Benefts if EchoStar‘s Petiion for Reconsideration is Granted
       EchoSter Will Provide Serviceto the UnitedStatesfrom EchoStar4 at 77° WL. Ttte
Bureau grants EchoStar‘s Petiion for Reconsidention, EchoStar can and will serve consumers
located in cerain southerm U.S. statesfrom the 77°W.L. orbital location. Spccificll, because
ofthe Mexican coverage requirements st fort in the QuetzSat concession,the EchoStar 4
satelte will not have ull coverage ofthe continental United Sats. Importatly,however,
EchoStar 4 will cover largeareas in several southern States. The additional capacity intothe
United States from 77° W.L. willbe used to provide augmented coverage to markets with
significant Spanish—speaking populations in portions ofCONUS where practicable. EchoStaris

communities in the United States and will continuet do so from EchoStar 4 at the 77° W.L.

        These benefits are consistent with the publi interest benefits in the recent rant of an
STA request (and reated applications)by DIRECTV Enterprises, LLC (*DIRECTV*).® In that
proceeting, DIRECTV had entred int a arrangement with TelesatCanada (*Telesa") whercby
DIRECTV relocate the DIRECTV 5 satellte to Telesa‘s Canadian—lcensed BSS slotat 72.5°
WL, from which DIRECTV would provide DBS service on an intrim basis tothe United

Stites. The Bureau approved thatarrangement, despit inding tht Canada did not meet the
*effective competitiveopportunites" tesfor comparable DBS services, because ofthe public
interet benefits associated with   increasing the number of marketsable to receive ocal—ito—local
programming fom DIRECTV—"
        EchoSter Will Provide Service to Mexico From EchoStr 4 at 77° WL. The EchoStar 4
satelite will also be used to provide directo—home (‘DTH")service to consumers in Mexico
Service ffom EchoStar 4 will begin immediately upon receipt oa DTH concession by QuetSat
Directo,an afiliate ofthe Mexican BSS concession holder, QuetzSat, . de R.L.de C.V.
EchoStar has been assured that such a concession will b received very soon. Moreover,as
representtives ofthe Mexican Govemment have receatly stated to the Chrirman, threlocation

improve the availablity and accessto the general population ofdigial servics hroughout
Mexico,includingeducation centes, ibraies, health centers (among others) as part of the —

Mexico NationalSystem, as well as other national social coverage programs."* The Mexican
Govemmentalsoadded that th e—Mexico program and the universal availbility of digial
services arvery important public policy gosls of the Mexican Government

       "Thus,asin the Commission‘s decision which allowed DIRECTV to move the DIRECTV
3 satelte to Canadian orbital location at 82° W.L.to provideservice o Canadian customens,"
EchoStar 4 willbeused almost immediately to benefit Mexican consumers upon it artival at the
77° WL. orbia loction by providing additional DTH services. Indec, the move ofEchoStar 4
to 77° W.L. willbe a key step towards thitroduction of a new and comperiive DTH service in
Mexico. In fct, the move willallow a second DTH compettorto ente the Mexican DTH
market, which currently has only one DTH provider. This immediate beneftfor Mexican
consumers is atlest as compellingas the DBS needs of Canadion consumers,which served as
the basisfothe publicintrest finding in the DIRECTY 3 Order:

410 61.5° WL. will alow EchoStar4 o augment t service provided by EchoStar 3 from

W.L is totlly duplicatve of programming avaiable rom the EchoStar 1 and EchoStar 2
satelites at 148° W.L

       Furthermore,noservie to Alaska and Hawaii wllbeaffectedas a resut of the move of

the EchoSta 4 satelite. While EchoSiar 4 was origially confiured to provideservice to
Alaska and Hawaiifrom the 119° W.L.slo, when questionsregarding satlite heath and other

issues led EchoStar o decide to move EchoStar 4 to157° WL., EchoStar requeste and received

a waiver of th requirement tserve Alaska and Hawaii from thatsatelt atthat location."

Purthermore, any locations in these states that might nevertheless be able to receiveservice rom
157° WL. would have at leasthe sameablitytoreceive service ffom EchoStar 1 or EchoStar 2
at 148° WL." n sum,since programming on EchoSar 4 duplcates programming avalable
from the 148° W.L. orbital location anyway, noservice to Alaska and Howaii wllbe lost, even
