Dear Ms. Dortch:                   EchoStar 5

                Pursuant to Section 309(f) of the Communications Act of 1934, as amended, 47
U.S.C. 0 309(f), EchoStar Satellite Corporation ((‘EchoStar”) hereby requests renewal of Special
Temporary Authority (“STA”) to operate its EchoStar 5 satellite at the 119.05O W.L. orbital
location and operate it over the channels licensed to EchoStar at 1 19O W.L. for a period of 180
days or until the Commission acts on Echostar’s previously-filed modification application to
allow regular operation. EchoStar 5 has been moved to the 1 19”W.L. orbital location and is
currently in temporary operations at that location. Enclosed is an FCC Form 159 and a check in
the amount of $145.00 to cover the applicable filing fee. Also enclosed is an additional copy of
the application, which we ask you date stamp and return with our messenger.

                On February 25,2003, EchoStar requested STA to move EchoStar 5 from the
110” W.L. orbital location to 119”W.L. and operate it at that location. The FCC’s International
Bureau granted that request until April 1,2003.’ On March 3,2003, EchoStar filed an
application for minor modification seeking regular authority to operate the EchoStar 5 satellite
over the channels licensed to EchoStar at the 1 19” W.L. orbital location.2 That application was

1)   During the drift of the Echostar 5 satellite from the 110" W.L. to 1 19"
     W.L. orbital location, EchoStar Satellite Corporation (Echostar) shall
     coordinate its TT&C operations with existing geostationary satellites to
     ensure that no unacceptable interference results from its TT&C operations;

2)   EchoStar shall not operate the communications payload of the EchoStar 5
     satellite while it is in drift;

3)   EchoStar shall coordinate use of EchoStar 5's command frequency with
     DIRECTV pursuant to the letter from DIRECTV dated February 19,2003.
