Dear Ms. Holiday: Pursuant to Section 21.25 of the Commission‘s Rules, Hughes Communications Galaxy, Inc. ("HCG") hereby requests special temporary authority ("STA") to use one of the transponders on Westar IV, Westar V or Galaxy VI for intra—, Caribbean transmissions, as described more fully in the attached letter requesting reqgular authority for such transmissions. This STA is being sought for the period beginning January 16, 1991 and ending March 16, 1991, in order to provide one—way occasional video services from points in St. Lucia to other points in the Caribbean, including St. Lucia, via one of the Westar IV, Westar V or Galaxy VI (formerly Westar VI—S) domestic satellites. HCG would like to begin testing this service on January 16, 1991, and initiate service on February 4, 1991. HCG will not initiate this service before receiving notification from the St. Lucia government that any necessary INTELSAT Article XIV procedures have been fulfilled.

Dear Ms. Holiday: Hughes Communications Galaxy, Inc. ("HCG") hereby requests expansion of its authority to utilize one additional transponder on one of the Westar IV, Westar V, or Galaxy VI (formerly Westar VI—S) domestic communications satellites for occasional video programming distribution between Caribbean locations. HCG would like to commence testing of this service on January 16, 1991, and initiate service on February 4, 1991. HCG makes this request pursuant to Western Union Telegraph Co. (Memorandum Opinion, Order and Authorization), 60 Rad. Reg. 2d [P&F] 1659 (1986) ("Western Union"). In that decision, the Commission authorized the use of any one transponder on any one of the Westar satellites for the distribution of video program material from Aruba to a network of receive stations also located in the Caribbean. The Commission stated that it would not preclude Western Union from requesting authority to use additional transponders on the Westar satellites for intra—Caribbean transmissions in the future should the need materialize. 60 Rad. Reg. 2d at 1661. Since the Western Union decision, HCG acquired from Western Union Telegraph Company the Westar III, IV, V and VI—S

Under the authority granted in Western Union, HCG is currently using one transponder on Westar V on an occasional basis for video transmissions from a transmit point in Aruba to a receive point in Aruba. HCG now requests that its authority be expanded to permit HCG to use one additional transponder on any of the Westar IV, Westar V and Galaxy VI domestic satellites for the provision of occasional video services between points in the Caribbean. HCG notes that the Commission need not consider any issues related to Article XIV of the INTELSAT Agreement in acting on HCG‘s request. See Western Union, 60 Rad. Reg. 2d at 1661. The services proposed herein will be neither U.S. domestic services nor "transborder" communications, but rather strictly intra—Caribbean transmissions. HCG initially plans to use the transponder that is the subject of this request to provide occasional video transmissions from points in St. Lucia to other points in the Caribbean (including St. Lucia itself), but the authority requested herein is for all intra—Caribbean transmission paths. The service being proposed herein need only be consulted under Article XIV of the INTELSAT agreement, if at all, by the St. Lucia government. HCG will not commence provision of this service before receiving notification from the St. Lucia government that any necessary INTELSAT Article XIV procedures have been fulfilled. For the foregoing reasons, HCG respectfully requests that its authority under Western Union be expanded to cover the use of any two transponders on Westar IV, Westar V or Galaxy VI for intra—Caribbean transmissions.
