                             Addition to Permitted List in Conventional Ku—Band


The Petition for Declaratory Ruling filed by Hispasat, S.A. (Hispasat), IBFS File No. SAT—PPL—
20140702—00082, to add the Amazonas—1 space station (Call Sign $2622) at the 55.5° W.L. orbital
location to the Commission‘s Permitted Space Station List in conventional Ku—band frequencies, is
GRANTED.‘ The operations of Amazonas—1 addressed by this grant are licensed by the Administration
of Spain. Each U.S. earth station with "ALSAT" or "Permitted List" designated as a point of
communication is authorized to access the Amazonas—1 space station at 55.5° W.L. to provide Fixed—
Satellite Service in the 11.7—11.83 GHz, and 11.95—12.2 GHz (space—to—Earth) and 14.0—14.125 GHz
(Earth—to—space) frequency bands to, from, or within the United States, subject to the parameters set forth
in the earth station license. Hispasat is also authorized to conduct telemetry operations using the 11701.25
MHz (space—to—Earth) frequency band. Communications between U.S.—licensed earth stations and the
Amazonas—1 space station must be in accordance with the terms, conditions, and technical specifications
contained in Hispasat‘s petition, the Federal Communications Commission‘s rules, and are subject to the
following conditions:

1.   This grant does not include provision of any Direct—to—Home (DTH) service, Direct Broadcast
     Satellite (DBS) service, or Digital Audio Service (DARS) to, from, or within the United States.

2. Communications between U.S.—licensed earth stations and the Amazonas—1 space station must be in
   compliance with all existing and future space station coordination agreements reached between Spain
   and other Administrations.

3. Amazonas—1 must be maintained with an east/west longitudinal station—keeping tolerance of +.05
     degrees of the 55.5° W.L. orbital location.

4.   Operations using Amazonas—1 to or from the United States must comply with the power levels
     specified in Section 25.212 of the Commission‘s rules, 47 C.F.R. § 25.212, unless Hispasat
     coordinates any operations using power levels exceeding the levels in Section 25.212 with all
     potentially affected adjacent satellites within 6 degrees orbital separation of the 55.5° W.L. orbital
     location. Hispasat must inform the Commission of any coordinated power levels to be used within
     the United States that are higher than the limits in Section 25.212. In addition, Hispasat must inform
     all affected U.S.—licensed earth station operators that Section 25.220 of the Commission‘s rules, 47
     C.F.R. § 25.220, applies to operations that exceed the power levels specified in Section 25.212.

5. This grant of market access will terminate in the event that the Amazonas—1 space station is relocated
   from the 55.5° W.L. orbital location or ceases to operate. In either case, Amazonas—1 will be
   removed from the Permitted Space Station List. If Hispasat seeks to provide service to the United
     States using another space station or seeks to operate Amazonas—1 from another location, it must file a
     new petition for market access and to have the station placed on the Permitted List.

     Failure to respond within this period will constitute formal acceptance of the terms as conditioned.

7. This grant is issued pursuant to Section 0.261 of the Commission‘s rules on delegated authority, 47
     C.F.R. § 0.261, and is effective immediately. Petitions for reconsideration under Section 1.106 or
     applications for review under Section 1.115 of the Commission‘s rules, 47 C.F.R. §§ 1.106, 1.115,

20140702—00082, to access the U.S. market by the Amazonas—1 space station (Call Sign $2622) at the
55.5° W.L. orbital location in the 13.75—14.0 GHz (Earth—to—space) frequency band, is GRANTED. The
operations of Amazonas—1 addressed by this grant are licensed by the Administration of Spain. Hispasat
is granted U.S. market access to provide Fixed—Satellite Service via Amazonas—1 at 55.5° W.L.
Communications between U.S.—licensed earth stations and the Amazonas—1 space station must be in
accordance with the terms, conditions, and technical specifications contained in Hispasat‘s petition, the
Federal Communications Commission‘s rules, and are subject to the following conditions:

3.      This grant is conditioned on Amazonas—1 being maintained with an east/west longitudinal station—

4.      Any earth station seeking to communicate with Amazonas—1 using the 13.75—14.0 GHz
        frequencies must file a separate application with the Commission, which will be considered on a
        case—by—case basis.

5.      Communications between U.S.—licensed earth stations and the Amazonas—1 space station in the
        13.75—14.0 GHz band (Earth—to—space) are subject to footnote US337 of the United States Table
        of Frequency Allocations, 47 C.F.R. § 2.106, US337, which requires any earth station in the
        United States and its possessions communicating with the Amazonas—1 space station in the 13.75—
        13.8 GHz band be coordinated through the National Telecommunications and Information
        Administration‘s (NTIA) Frequency Assignment Subcommittee to minimize harmful interference
        to the National Aeronautics and Space Administration (NASA) Tracking and Data Relay Satellite
        System‘s (TDRSS) forward space—to—space link (TDRSS forward link—to—LEO).

6.      Operations of any earth station in the United States and its possessions communicating with the
        Amazonas—1 space station in the 13.75—14.0 GHz band (Earth—to—space) must comply with
        footnote US356 to United States Table of Frequency Allocations, 47 C.F.R. § 2.106, US356,
        which specifies a mandatory minimum antenna diameter of 4.5 meters and the maximum
        equivalent isotropically radiated powers (EIRP) of any emission should be at least 68 dBW and
        should not exceed 85 dBW. Operations of any earth station located outside the United States and
        its possessions communicating with the Amazonas—1 space station in the 13.75—14.0 GHz
        frequency band (Earth—to—space) must be consistent with footnote 5.502 to the ITU Radio
        Regulations, which allows a minimum antenna diameter of 1.2 meters for earth stations of a
        geostationary satellite orbit network and specifies mandatory power limits.

7.       Operations of the Amazonas—1 space station receiver, receiving in the 13.75—14.0 GHz band, shall
         not claim protection from radiolocation transmitting stations operating in accordance with the
         United States Table of Frequency Allocations. ITU Radio Regulation No. 5.43 does not apply.

8.       Operations of earth stations in the United States and its possessions communicating with the
         Amazonas—1 space station in the 13.75—14.0 GHz frequency band (Earth—to—space) are encouraged
         to cooperate voluntarily with NASA to facilitate continued operation of NASA‘s Tropical
         Rainfall Measuring Mission (TRMM) satellite.‘

9.       Operations of any earth station in the United States and its possessions communicating with the
         Amazonas—1 space station in the 13.77 to 13.78 GHz band (Earth—to—space) must comply with
         Footnote US357 to the United States Table of Frequency Allocations, 47 C.F.R. 2.106, US357,
         which specifies that the EIRP density of emissions must not exceed 71 dBW in any 6 MHz band
         for communications with a space station in geostationary—satellite orbit." Operations of any earth
         station located outside of the United States and its possessions communicating with the
         Amazonas—1 space station in the 13.77—13.78 GHz band (Earth—to—space) to provide service to or
         from the United States must comply with footnote 5.503 to the ITU Radio Regulations, which
         specifies a required maximum EIRP density of emissions (limit is dependent on antenna
         diameter) for communications with a space station in geostationary—satellite orbit.

10.      This grant of market access will terminate in the event that the Amazonas—1 space station is
         relocated from the 55.5° W.L. orbital location or ceases to operate. In either case, its grant of
         market access for the 13.75—14.0 GHz band will be revoked. If Hispasat seeks to provide service
         to the United States using another space station or seeks to operate Amazonas—1 from another
         location, it must file a new petition for market access.




*NASA‘s TRMM satellite system radar in the 13.793—13.805 GHz band remains operational and is a highly
valuable and visible United States asset with a broad range of international users. Accordingly, NTIA has requested
cooperation from the Commission and non—Federal Government entities in providing assistance in reducing
interference with the TRMM radar. Specifically, NTIA requests that FSS earth stations in the 13.793—13.805 GHz
band located south of 39° N and east of 110° W operate with emission levels below —150 dBW/600 kHz at the
TRMM space station receiver. Letter from Frederick R. Wentland, Acting Associate Administrator, Office of
Spectrum Management, NTIA, to Donald Abelson, Chief, International Bureau, FCC (Feb. 28, 2002). Considering
the secondary nature of the TRMM operation, NTIA‘s request is not a condition of this authorization. The
Commission, however, urges all operators of earth stations accessing the Amazonas—1 space station in the 13.75—
14.0 GHz band to cooperate voluntarily with NASA to facilitate cooperate voluntarily with NASA to facilitate
continued operation of the TRMM satellite.
