Attachment to Grant Application of SES Americom, Inc. IBFS File No. SAT—MOD—20121224—00221 Call Sign S$2181 The application of SES Americom, Inc. (SES Americom), IBFS File No. SAT—MOD—20121224— 00221, to modify the authorization for its AMC—16 space station (Call Sign $2181) at the 85° W.L. orbital location IS GRANTED. Specifically, SES Americom is authorized to reorient the spot beams on the AMC—16 space station in the 18.6—18.8 GHz (space—to—Earth), 19.7—20.2 GHz (space—to—Earth), 28.4—28.6 GHz (Earth—to—space), and 29.5—30.0 GHz (Earth—to—space) frequency bands, such that the 10 spot beams still provide coverage of the continental United States, but provide a slightly different coverage for each beam. Operations pursuant to this authorization must be in accordance with the technical specifications set forth in SES Americom‘s application and the Commission‘s rules, and are subject to the following conditions: 1. While at the 85° W.L. orbital location, SES Americom must maintain the AMC—5 spacecraft with an east/west longitudinal station—keeping tolerance of +/— 0.05 degrees. 2. No changes are authorized to the previously authorized technical parameters of the Ku—beams aboard AMC—16 in the 11.7—12.2 GHz (space—to—Earth) and 14.0—14.5 GHz (Earth—to— space) frequency bands. 3. With the exception of the reorienting of the 10 spot beams in the 18.6—18.8 GHz (space—to—Earth), 19.7—20.2 GHz (space—to—Earth), 28.4—28.6 GHz (Earth—to—space), and 29.5—30.0 GHz (Earth—to—space) frequency bands, SES Americom must comply with the conditions placed on operations of AMC—16 in IBFS File No. SAT—LOA—19950929—00133 et al. 4. Operations of AMC—16 under this grant of authority must comply with any agreement previously coordinated with U.S. Government systems pursuant to footnote US334 to the Table of Frequency Allocations. See GE American Communications, Inc., Order and Authorization, 12 FCC Red 6475, 6486 para. 34 (Int‘l Bur. May 9, 1997). 5. We grant the request of SES Americom for waivers of Sections 25.114(d)(14)(ii) and 25.283(c) of the Commussion‘s rules, 47 C.F.R. §§ 25.114(d)(14)(1i) and 25.283(c). These rules require an applicant to demonstrate that all stored energy will be removed at the spacecraft‘s end of life. AMC—16 is a Lockheed Martin A2100 model spacecraft that is not designed to vent all of its pressurized systems. Following launch of the spacecraft on December 17, 2004, two oxidizer tanks were permanently sealed by firing pyrotechnic valves. As a result, SES Americom states that at the end of AMC—16‘s operational life, there will be oxidizer remaining in the tanks that cannot be vented. SES Americom states that the residual oxidizer in AMC—16‘s two oxidizer tanks have masses of 10.85 kg each and volumes of 327.5 liters each at a temperature of 21° Celsius. SES Americom states that the pressure of each of the oxidizer tanks is 18.33 bar at a temperature of 21° Celsius. We grant the requested waiver because AMC—16 was launched before Section 25.283(c) became effective and compliance would require direct retrieval of the spacecraft, which is not currently possible. In making this determination, however, we note that the information submitted in the application is not sufficient to support a finding that the intent of the rule would be satisfied by the described procedure for sealing the oxidizer tanks.
