The application of SES Americom, Inc. (SES Americom), IBFS File No. SAT—MOD—20111220—
00243, as supplemented, to modify the authorization for its geostationary—satellite orbit space
station, AMC—3 (Call Sign $2162), to specify operations at the 67° W.L. orbital location, rather
than at $6.9° W.L., is GRANTED.!‘ Accordingly, SES Americom is authorized to operate AMC—
3 at 67° W.L. to provide Fixed—Satellite Service (FSS), including direct—to—home services, in the
conventional Ku—band frequencies of 11.7—12.2 GHz (space—to—Earth) and 14.0—14.5 GHz (Earth—
to—space)." In addition, SES Americom is authorized to conduct Telemetry, Tracking, and
Command (TT&C) operations necessary to maintain AMC—3 at 67° W.L. using center
frequencies located at 3700.5 MHz (space—to—Earth), 4199.5 MHz (space—to—Earth), 12.198 GHz
(space—to—Earth), and 6423.5 MHz (Earth—to—space). This authorization is subject to the technical
specifications set forth in SES Americom‘s application, Federal Communication Commission
(Commission) rules not waived herein, and the conditions set forth below.
         1.    All operations must be on an unprotected and non—harmful interference basis, 7.e.,
the AMC—3 space station must not cause harmful interference to, and must not claim protection
from interference caused to it by, any other lawfully operating station. In the event of any
harmful interference, SES Americom must cease operations immediately upon notification of
such interference, and must inform the Commission, in writing, immediately of such an event.
       2.   In connection with the provision of service in any particular country, SES
Americom is obliged to comply with the applicable laws, regulations, rules, and licensing
procedures of that country.
       3.    SES Americom must maintain the AMC—3 space station within an east/west
longitudinal station—keeping tolerance of + 0.05 degrees of the 67° W.L. orbital location.
        4.    This authorization is issued with the understanding that, to the extent SES
Americom and its affiliated companies, pursuant to any arrangement with the Colombian
Administration or the Andean Community, conforms its operations to any parameters agreed to
in coordination agreements between the Colombian Administration and other Administrations,
responsibility for both compliance with, and enforcing compliance with, those arrangements and
agreements is a matter that would arise under private law.
        5.    The United States remains the licensing administration of the AMC—3 space station
and its communications payloads for purposes of International Telecommunication Union (ITU)

‘ On January 13, 2012, the Satellite Division granted, with conditions, authority to SES Americom for a period of 60
days, commencing on January 13, 2012, to conduct telemetry, tracking, and command operations during the drift to,
and while operating at, the 67° W.L. orbital position, and to operate the AMC—3 space station in the conventional
Ku—band frequencies of 11.7—12.2 GHz (space—to—Earth) and 14.0—14.5 GHz (Earth—to—space) to provide fixed—
satellite service (FSS), including direct—to—home service, temporarily from the 67° W.L. orbital location. IBFS File
No. SAT—STA—20111220—00244. On March 13, 2012, the Satellite Division granted authority to SES Americom to
continue operations on the space station for a period of sixty days in accordance with the conditions imposed on the
January 13, 2012 grant. IBFS File No. SAT—STA—20120305—00036. A further extension of this special temporary
authority is pending. See IBFS File No. SAT—STA—20120509—00082.
> While the AMC—3 space station is capable of operating in both the C— and Ku—band, SES does not propose to
operate the AMC—3 C—band frequencies while the spacecraft is located at 67° W.L., but does propose to use limited
C—band frequencies for TT&C.

  Radio Regulation 18.1 and is the administration responsible for the operations of AMC—3. The
  U.S. Administration will not object to use of the AMC—3 satellite by the Colombian
  Administration, as Notifying Administration for the Andean Community, for claiming bringing
  into use or continuing the use of orbital assignments at 67° W.L. This grant does not in any way
  express a view concerning, or agreement as to, the validity or lack of validity of any ITU filing at
  or within the vicinity of the 67° W.L. orbital location.
          6.    SES Americom‘s request for a waiver of Section 25.114(d)(3) of the Commission‘s
  rules, 47 C.F.R. § 25.114(d)(3), is granted. Section 25.114(d)(3) requires applicants to provide
  predicted space station antenna gain contour(s) for each transmit and each receive antenna beam
  and nominal orbital location requested. The main purpose of the contour map is to allow
  evaluation of the potential for harmful interference with other operators and services in the
  frequency band. SES Americom states that it did not provide gain information for the global
  horn antenna in accordance with Section 25.114(d)(3) because the space station manufacturer did
  not provide .gxt data for this antenna. We find that Figure 1 in Section 2.5 of the Technical
  Appendix, together with the descriptive characterization provided on page 5 of the application,
  provide a sufficiently complete description of the global horn antenna on the AMC—3 space
  station to enable the Commission to determine whether the AMC—3 space station meets the
  Commission‘s technical requirements.
          7.     SES Americom‘s request for waivers of Sections 25.114(d)(14)(ii) and 25.283(c) of
— the Commission‘s rules, 47 C.F.R. §§ 25.114(d)(14)(ii), 25.283(c), is granted. Sections
  25.114(d)(14)(ii) and 25.283(c) specify that space stations must discharge all stored energy
  sources at end—of—life of the space station. AMC—3 is a Lockheed A2100 series spacecraft and
  does not completely discharge all stored energy at end of life. SES Americom states that
  residual oxidizer will not be vented at the spacecraft‘s end of life because the two tanks
  containing this oxidizer were sealed shortly after the satellite‘s launch on September 3, 1997.
  SES Americom further states that the two oxidizer tanks are connected, that each tank has a
  volume of 229 liters, and that there is a total mass of 13.05 kg of dinitrogen tetroxide and 1 kg of
  helium in the tanks at end of life." The information submitted by SES Americom is not sufficient
  to support a finding that the underlying purpose of Section 25.283(c) is served by sealing the
  oxidizer tanks without completely venting them. Nevertheless, we grant SES Americom a
  partial waiver of Sections 25.114(d)(14)(ii) and 25.283(c). AMC—3 was launched and the tanks
  sealed before Section 25.283(c) was adopted. Furthermore, compliance with Section 25.283(c)
  would require direct retrieval of the spacecraft or launching a servicing mission to the spacecraft,
  which is not practicable at this time. This action is without prejudice to future licensing
  decisions in connection with other spacecraft of the same manufacturing series.

          8.     Within 30 days of completion of any end—of—life maneuvers for the AMC—3
  spacecraft, SES Americom must send a letter to the Chief, Satellite Division, International
  Bureau, indicating the apogee and perigee of the AMC—3 disposal orbit.

  > On June 2, 2012, SES Americom filed a letter to clarify certain aspects of the venting requirements of AMC—3 at
  67° W.L. Letter from Karis Hastings, Counsel for SES Americom, Inc., to Marlene H. Dortch, Secretary, Federal
  Communications Commission, IBFS File No. SAT—MOD—20111220—00243 (filed Dec. 22, 2011). This grant takes
  into account those clarifications.

        9.    SES Americom‘s request for a waiver of Section 25.202(g) of the Commission‘s
rules, 47 C.F.R. § 25.202(g), is granted. Section 25.202(g) requires "telemetry, tracking and
command (TT&C) functions for U.S. domestic satellites must be conducted at either or both
edges of the allocated band(s). Frequencies, polarization and coding must be selected to
minimize interference into other satellite networks and within their own satellite system." SES
Americom requests this waiver for the proposed use of command carriers in the C—band center
frequency of 6423.5 MHz and telemetry beacons in the C—band center frequencies of 3700.5
MHz and 4199.5 MHz (space—to—Earth) because these TT&C operations occur at the band edges
of an FSS band other than the Ku—band in which it is providing service. This waiver is based
upon the following findings: (a) AMC—3 was designed to operate with both service links and
TT&C functions in the C—band; (b) SES Americom has coordinated C—band TT&C operations
with adjacent satellite operators operating in the C—band; (c) AMC—3 is only authorized to
operate on an unprotected and non—harmful interference basis. As a condition of this waiver,
SES Americom must accommodate future space station networks that are compliant with Section
25.202(g). Further, SES Americom must operate AMC—3 pursuant to any existing or future
coordination agreements for this location.
         10. Grant of this authorization does not convey to SES Americom any authority to
operate a space station at the 67° W.L orbital location beyond the term granted herein, nor any
status in the United States satellite licensing process relative to applications for authority to
operate a regularly authorized satellite at this orbital position.
        11. Nothing in this authorization extends the license term for this space station, Call
Sign S$2162, which expires on September 30, 2012.
        12. SES Americom is afforded thirty days from the date of this action to decline this
authorization as conditioned. Failure to respond within this period will constitute formal
acceptance of the authorization as conditioned.
        13.   This action is issued pursuant to Section 0.261 of the Commission‘s rules on
delegated authority, 47 C.F.R. § 0.261, and is effective immediately. Petitions for
reconsideration under Section 1.106 or applications for review under Section 1.115 of the
Commission‘s rules, 47 C.F.R. §§ 1.106, 1.115, may be filed within 30 days of the date of the
public notice indicating that this action was taken.
