We have been working with Spectrum Five for many months now and know they are on the verge of securing financing and moving forward on plans to launch the satellite and provide important services beginning in 2013. This tentative decision by the International Bureau has very significant consequences in terms of depriving consumers of the use of this capacity to help alleviate congestion on wireless networks. In addition, this may inadvertently trigger a retaliatory response by foreign governments which could inure to the detriment of the U.S. satellite industry. Because the consequences of this tentative decision are so significant, I strongly believe as a matter of good governance and administrative law that this matter should be decided by the full Commission, not by staff at one of the Bureaus. We would like the opportunity to brief you in full on all of the progress Spectrum Five has made on the path to satisfying all possible FCC concerns, and ask that we be given that opportunity in the context of a process that allows the fate of this important spectrum to be decided by the duly appointed Commissioners.
