unprotected basis,relative to fixed stations (FS),to ts exising authorization‘ to operate the in—
orhit Fixed Satellite Service(FSS) Cand Ku—band INTELSAT 707 satelite(Call Sign: $2398) at
53° W.L. (307° E) IS GRANTED._ Accordinaly, Intelsat North America is authorized to
operate the INTELSAT 707 satellite at 53° W.L. (307° EL)in order to provide domestic service
in the extended Ku—bands, 1095—11.2 GHfz (spaceto—Earth) and 1145—11.7 GHz (spaceto—
Earth, in accordance with the terms, conditions, and technical specifications set forth in its
application, this Attachment and the Federal Communications Commission‘s (Commission)
Rules. This is in addition to Intelsat North America‘s continuing authorty to provide protected
international service in the extended Ku—bands, 10.95—11.2 GHz, and 11.45—11.7 GHz(space—to—
Earth, as well as protected interntional and domestic services in the C: and Ku— bands, 3625—
3700 MH3700— 4200 MHand 11.7—11.95 GHz (space—to—Rarth; and 5850— 5025 MHz, 5025—
6425 MHz and 14.0—14.5 GHz (arthto—space).". Intelsat North America also has existing
authority to operate the INTELSAT 707 sitellite in the 12.—12.75 GHz (space—to—Rurth)
frequency band over Intemational Telecommunication Union (FTU) Regions 1 and 3. The
conditions oIntelsat North America‘s existing authorizaton otherwise remain unchanged

                Section 25.202(e)(1) of the Commission‘s Rules, 47 CFAR. § 25.202(e)(1)in
                order to provide domestic service using earth stations that receive in the 10.95—
                 11.2 GHz and 11.45—11.7 GHz bands ARE GRANTED as conditioned. We find
                that waiver of these rules would not undermine their purpose because the waiver
                involves only passive receive—only earth stations thatare not capable of causing
                interference into fixed. stations operating in the same frequeney band.
                Furthermore, because Intelsat has agreed to accent any level ointerference from
                fixed stations intis receive—only earth sttions" operations in the extended Ku—
                band," FS operators would not be required to coordinate theirstation operations
                with the space station operator‘s receive—only earth stations‘ operations. Under
                these circumstances, we determine that an additional coordination burden is not
                placed upon FS operatorsand their abilty to expand service in the future is not
                restrited in any manner. Grant here as conditioned is consistent with prior
                Commission precedent."

        2)=—    Intelsat North America shall operate its earthstations in the 1095—11.2 GHfz and
                11.45—11.7 GHbands that provide domestic service on an unprotected, non—
                interference basis relative t fixed stations and, as such, Intelsat North America
                may not cause harmfulinterference to, or claim protection from, ixed stations to
                which frequenciesin the 10.95—11.2 GHz and 11.45—11.7 GH bands have either
                alteady assigned, or to which frequencies in the 10.95—11.2 GHand 11.45—11.7

                end—users receiving service from resellers accessing capacity on the INTELSAT

                with regards to domestic service is being provided on an uncoordinated basis,

                   Intelsat North Amorica LLC Request for Waiver

        Pursuant to Section 1.3 ofthe Commission‘s rules,‘Intelsat North America LC
("Intlsat®) respectfuly requests waivers offootnote NG 104 of the U.S. Table of
Allocations" and foonote 2 of Section 25.202(a)(1) othe rules." Intelsat seaks these
walvers in order to provide domestic servie in the U.S. in extended Ku—bands 10.95—
11.2 GHz and 11.45—11.70 GHiz, on a non—interference basis,using the flowing
satelites: INTELSAT 905, operating at 335.5° EL. (24.5° WJL),INTELSAT 707,
operating at 307° E.L.(63° WL.),INTELSAT 701, operating at 180° E.L. (180° W.L.)
and INTELSAT 605, operating at 174° EL. (186° W.L). As explained more fuly below,
there is good cause to walve thase requirements and doing so would be consistent wih
Commission precedent. Grant f his requestwill serve the publc interest by making
addional capaciy avaiable for communications services, wihout undermining the
purpose of the Commission‘s rules*

uplink in the 14.0—14.5 GHz frequency band, and in the downlnk in the 10.95—11.2 GHz,
11.45—11.7 GHz frequency bands. in addtion, INTELSAT 701 and INTELSAT 707 also
operate in the 11.7—11.95 GHz and 12.5—12.75 GHiz (te later over Regions 1 and 3)
frequency bands
        The 10.05—11.2 GHz and 11.45—11.7 GHz bands are shared on a co—primary
basis between the fired satelite service (FSS‘)and the fived service (FS‘). Footnote
NG104 ofthe Table of Alocations and footnote 2 of Section 25 202(2)1) of the
Commission‘s rules limithe use of the 10.95—11.2 GHz and 11.45—11.7 GHz frequency
bands to "intermational systems."* The Commission has interpreted this restricton to
mean that these bands may be used only to provide intemational service." The purpose
of NG 104 and footnote 2 of Section 25.202(a)(1) is to limithe number of FSS earth
stations wih which the co—primary FS would need to coordinate."
       Intelsat seoks a waiver of NG 104 and footnote 2 of Section 25202(a)(1) in order
to offer domestic services in the U.S.in e 10.95—11.2 GHz and 11.45—11.7 Gitz

INTELSAT 707 satelte, operating at 307° E.L.(63° WL),INTELSAT 701 satelit,
operating at 180° E.L. (180° W.L.), and INTELSAT 605 sateli, operating at 174° EL.
(186" W.L). These downlink transmissions wil be paired with upin‘ transimissions,
respectively, in the 14.0—14.25 GHz and 14.25—14.5 GHz bands, which are not subject to
the "international only"restiction of NG 104 and footnote 2 of Section 25202(a)(1)®
Intelsatwil provide these services only on a non—interference/non—protected basis, and
therefore will not need to coordinate earth stations in the 10.95—11.2 GHz and 11.45—11.7
GHz bands witFS stations.

11. 6oob cause exists ror a waver
       Waiver of the Commission‘s rulesis warranted when ‘good cause"is shown.!" A
waiver may be granted if the grant ‘would not undermine the polcy objective of the rule
in queston and would othentise serve the publc interest""" A waiver ofthe Table of
Alocations is generally granted "when there is itl potentalinterference into any
service authorized under the Table of Frequency allocations and when the
nonconforming operator accepts any interference from authorized services ""

        The Commission previously has determined that these crieria were satisied in
an identical waiver request by Echotar." Specifaly, the Bureau found that waing
NG 104 and footnote 2 of Section 25 202(2)1) would not undermine the purpose of the
rules ithe party seeking a walver:(1) willbe utifzing earthstations that are receive—only
in these bands and thus ‘not capable of causing interference into FSstations‘ operating
in the bands; and (2) agrees to"accept any level o nterference from FS stations‘ in
these bands."*
        Intelsat satities these crteria. The earth stations operating in the 10.95—11.2
GHz and 11.451.7 GHz bands served by INTELSAT 905 at 298.5° E.L. (24.5° W.L),
INTELSAT 707 at 307° E.L. (63° WL),INTELSAT 701 at 180° EL (180° W.L), and
INTELSAT 605 at 174° E.L. (186° W.L., lkethose to be used by EchoStar, willnot
transimi in these bands and Intelsat agrees to accept any lavel ofiterference into those
earth stations from FS stations in these bands. Accordingl,the earth statons operating
in these bands pose no interference concerns withrespect to co—frequency FS stations
        Grant of Intelsats waiver request, moreover,wil have no impact on the potental
for interference from the INTELSAT 905, INTELSAT 707, INTELSAT 701, and
INTELSAT 605 satelits. The downlink transmissions of these satelitesin the 10.95—
11.2 GHz and 11.45—11.7 GHz bands already complywith the powerfux density imits
set outin the Commission‘s rulesfor operation over the U.5.," and Intelsat does not
propose to lterany operational characteristics ofthese satelites folowing a grant ofits
waiver request

        Intelsat also agrees to abide by the customer notfication requirements that the
Bureau imposed on EchoStar." Intelsat wil inform its customers in writing,including
any customers receiving end—user services from resellers accessing capaciy on
INTELSAT 905 at 395.5° E.L. (24.5° W.L), INTELSAT 707 at 307° E.L.(68° WL),
INTELSAT 701 at 180° E.L. (180° W.L.) and INTELSAT 605 at 174" E.L. (186° W.L),of
the potentialfor nterference from FS operations i the 10.95—11.2 GHz and 11.45—11.70
GHfrequency bands
        Finally, a grant of Intlsat‘s waiver requestwl serve the puble interest by
expaning the range of services thatIntelsat can provideto the publc. i particular, a
grant wl enable Intelsat to make additional capacit available i the 10.95—11.2 GHz
and 11.4—11.70 GHz bands for services to customers in the United States:

        For the reasons stated herein,grant of ntelsats waiver reauest wil serve the
puble interest without undermining the purposes of the Commission‘s rules.
Accordingly, and for good cause shown, Intelsat asks that the Commission grant this
waiver request,
