Dear Mr. Weimer:
         "This leter requests additional information regarding above referenced modification application
filed by Celsat America,Inc.(Celsa). The appliction requests an extension of Celsat‘s milestone to
complete construction oand Iaunch it satelite nto ts assigned orbital location. Threquested
extension is premised on the bankruptey ofthe satelite manufacturer, Space Systems/Loral(Loral). In
the application, Colst notes that under bankruptey law Loralisentiled t accept or rject the
manufacturing contract. Although Celsat statesthat an amendment to the contract was exccuted with
Loral, the application does notindicate whetherthe amended contract has been assumed by Loral and
approved by the bankruptcy court
        To assisin the processing of Celst‘s modification application, please explain whether Loral has
assumed the amended contract. Further, sate whether this action requires bankruptey court approval, and
ifo, whether the bankruptcy court has approved the amended contract. In addition, because the
extension request is based on Loral‘s bankrupicy, please notify the Commission ofCelsat‘s understanding
ofthanticipated date that Loralis expected to emerge from bankruptey. This information should be
submited no late than January 28, 2005 with a courtsy capy to Alyssa Roberts ofmy staf.
