Federal Communications Commission‘s ("Commission®) Rules.
2       DIRECTV‘s Ka—band system authorization is MODIEIED to reflect the orbital loc
assignment of 103.05° W.L. DIRECTV‘s Ka—band system authorization‘ 1 MODIFIED to
reflectthe deletion of authority to operate inter—sateltelinks. DIRECTV‘s Ka—band system
authorization IS MODIRIED at 103.05° W.L. to reflectits service links the following Ka—band
frequencies: 18.365—18.53 Gile, 18.57—18.738 GHz, 19.7—20.2 GHz, 28.36—28.525 GHtz, 20.26—
29425 GHe and 29.5—30.0 GHz." All such frequency bands can use cithelef—hand circular
polarization (°LHICP")oright—hand circular polarization (*RHCP"),exceptfothe 28.36—28.525
GHte band which can only use LHCP.

4.       We GRANT DIRECTV‘s request for waiver of Section 25.210(c)of the Commission‘s
rules requiringsatelltes in the fixed.satellite serviceto have the capabilityto change transponder
saturation fux densityby eround command in 4dB increments over a range of 12dB. For the
SPACEWAY—1 satelite, DIRECTV satstesthis requirement in the 29.5—30.0 GHz band, but not
in the 28.36—28,525 GHz and 29.26—294425 GHz bands. DIRECTV states thatthe range for the

5. This amounts to an overallreduction of340 megaberte in bandwith from whatthe Commission
previously uthorizedforHughes‘s Ka—band service inks(CallSign 2191). Previowls, Hushes was
authorized to oerate in the ollowingfequencies: service uplinkin 28 35.28.6 GHz, 29.25—30.0 GHz
bands for plink transmissions and service downtinks in 18.3—18.8and 197202 GHt band. See d

28.35—28.6 GHz band is 8 dB and forthe 29.25—29.5 band is 6 dB. The main intent ofthe gain
step requirement is to limit the potentialfor uplink interference to ofrom adjacentsatelites,
where power levels may be significantly different. In the concemed bands, DIRECTV employs
automatic level control circuiry (*AL.C) that maintains a constant input to the finalspacecraft
ampliier over a range of receive signal evels. DIRECTV statesthat it willadhere to the Ka—
band blanket lensing ofearthsttions (47 C.F.R. §25.138) which serve to ensure that Ka—band
satellites spaced as close as 2 degrees can operate ifthe Earth stations operate within the
allowable of—axis EIRP density. The combination ofthese methods meet the itent ofthe ule.
Therefore, the Commission finds suffiient reason t grant a waiver of Section 25.210(c)in the
28.36—28.525 GHe and 29.26—20425 GHz bands.

5..      We DISMISS DIRECTV‘s request for waiver ofthe fulkfrequeney reuse requirements
contained in Section 25.210(d)°ofthe Commission‘s rules with respect to a sinale uplink beam
using the 28.36—28,525 GHe band. The rule requires the use of orthogonal polarizations within
the same beam and/or through the use of spatilly independent beams. According to DIRECTV,
the proposed SPACEWAY—1 satellte will comply with thi requirement iall 133 uplink beams
except one:the uplink beam in the 28 35—28.6 GHz band, which operates using only left hand
circular polarization. Based on the receive antenna pattems that DIRECTV has provided in
Exhibit C ofFCC Form 312, a waiver request was found to be unnecessary because spatally
independent beams are utized.
6.      DIRECTV‘s request fora waiver ofthe cross—polarization isolation requirements,
contained in Section 25.210() ofthe Commission‘s rules is GRANTED. Section 25.210() ofthe
Commission‘s rules require the ratio of the on—axis co—polar gain to the cross—polar gain ofthe
anternain the assigned frequency band be at east 30 dB within ts primary coverage area." The
SPACEWAY—1 mult—spot beam receive antenna that operates in the 29.25—30 GHz range has
been desizned to meet a cross—polarization requirement of18.8 dB. The widearea beam transmit
antenna, which operates on specific authorized frequencies in the 18.3—18.8 GHz band, is
desizned to meetthe cross—polarization requirement of19 dB. DIRECTV states that is design
does not technically provide 30 dB cross—polarization over the entie coverage area. DIRECTV
statesthatits cross—polarization interference is an intr—system design issue thatdoes not affect
inter—system coot      on and therefore will not affect ther Ka—band satelite systems. DIRECTV
plans to employ        digtal modulation with forward error correction coding on both polarization
senses to reduce system sensiivty to cross—polarization iterference not to mention polarization
isolation,directivity and antenna implementation losses have also been optimized for best
performance. Based on DIRECTV‘s representations that it is using digial, rather than analog
modulation, and that other Ka—band satllte systems willnot be affected by it operation, we find
that        the publicinterest to waive Section 25.2100)—® We find that this grant is consistent
with previous Commission actions and will permit DIRECTV to optimizethe design of
SPACEWAY—1 without causing unaeceptable losses of signal quality or unduly adding to the
spacecraft‘s weight, complexity or cost

1        We GRANT DIRECTV‘s request for waiver of Sections S6," $7," $8," $10°" and S13"
of Schedule S. Considering the complexity ofthe SPACEWAY—1 satellte design,the amount of
information that would need to be provided i these Sections ofthe Schedule S Form would be
extensive and, in many ways, redundant. The information provided by DIRECTV in its Schedule
S Form is sufficient for us to determine whether the system meets the Commission‘s technical
requirements.
8.       DIRECTV shall prepare the necessary information, as may be required, forsubmission to
the TT toinitate and complete the advance publication, intermational coordination, due
diligence, and notification process ofthis space station,in accordance with the ITU Radio
Regulations. DIRECTV shall be held responsibleforall cost recovery fees associated with these
ITU filngs. We also notethat no protectionfrom iterference caused by radio stations authorized
by other administrations is guaranteed unless coordination and notification procedures are timely
completed or, with respectto individual administations, by successfully completing coordination
aureements. Any radio station authorization for which coordination has not been completed may
be subjectto additional terms and conditions asrequired to effect coordination of the frequency
assignments oother administrations. See 47 C.FR. § 25.111(b).
9.      DIRECTV must coordinate ts downlink operationsfor thspecific frequencies
authorized in the 183—18.8 GHz and 19.7—20.2 GHz bands with U.S. Government systems,
including Govermment operations to earth stations in foreign countries, in accordance with
footmote US334 to the Table of Frequency Allocations, 47 C.F.R.§2.106.
10.     DIRECTV must conduct ts operations parsuant to this authorization in a manner
consistent with the power Aucdensity requirements of footnote US25S t the Table of Frequency
Allocations, 47 C.FR. § 2.106, 47 C.F.R. § 25.138(a)(6),and 47 C.F.R. § 25.208, of the
Commission‘s Rules.
11. This authorization does not in any way constiute an approval ofDIRECTV‘s post—
mission disposalplans for SPACEWAY—1.
 12.     DIRECTV must provide written statementto the Commission within 60 days of the
date ofthis authoriztion that identiiesany known sateltes located at, or planned to be located
at, DIRECTV‘s assigned orbital location, or assigned in the vicinity ofthat location such that the
station—keeping volume ofthe respective satelites might overlap, and that states the measures that
will be taken to prevent in—orbit collsions with such satelites. This statement should address any
Hicensed FCC systems, o any systems applied for and under consideration by the FCC. The
statement need not address every fling with the ITU that meetsthese crteri, but should assess
and address any systems reflcted in TTU filings that are in operation or that DIRECTV believes

13. The license term for the SPACEWAY—1 satellte, Call Sign $2191, is fifleen years and
will begin to in on the date that DIRECTV certifiesto the Commission that the satelite hasbeen
successfully placed ito orbit and its operation fully conforms to the terms and conditions ofthis
authorization.

14.      DIRECTV is affarded thiry days from the date ofrelease ofthis grant and authorization
to declinethis authorization as conditioned. Failure to respond within this period will constitute
formal acceptance of the authorization as conditioned.
15. This grant iissued pursuant to Section 0.261 ofthe Commission‘srules on delegated
suthority, 47 C.F.R. § 0.261, and is effective upon releas. Petitions for reconsideration under
Section 1.106 or applications for review under Section .115 ofthe Commission‘s rules, 47
CR 5§ 1.106, 1115, may be filed within 30 days ofthe date ofthe public notice indicatingthat
this action was taken.
