PanAmSat Licensee Corp.' s application, SAT-MOD-20040405-00077, IS GRANTED and PanAmSat Licensee Corp.'s authorization to operate its PAS-8B satellite call-sign S2359 currently assigned to the 43.O"W.L. orbital location is modified to reflect operations at 43.1 O W.L. with k0.05" longitudinal station-keeping, in the frequency bands 10.7 - 11.45 GHz, 12.75 - 13.25 GHz and 13.75 - 14.0 GHz, in accordance with the terms, conditions, and technical specifications set forth in its application, this Attachment and the Commission's Rules. 2. PanAmSat Licensee Corp. shall prepare the necessary information, as may be required, for submission to the ITU to initiate and complete the advance publication, international coordination, due diligence, and notification process of this space station, in accordance with the ITU Radio Regulations. PanAmSat Licensee Corp. shall be held responsible for all cost recovery fees associated with these ITU filings. We also note that no protection from interference caused by radio stations authorized by other administrations is guaranteed unless coordination and notification procedures are timely completed or, with respect to individual administrations, by successfully completing coordination agreements. Any radio station authorization for which coordination has not been completed may be subject to additional terms and conditions as required to effect coordination of the frequency assignments of other administrations. See 47 C.F.R. 6 25.1 11(b). 3. Action on this application is without prejudice to possible enforcement action in connection with operations of the PAS-8B satellite prior to this action. 4. PanAmSat Licensee Corp. is afforded thirty days from the date of release of this grant and authorization to decline this authorization as conditioned. Eneineerinp Statement PanAmSat Licensee Corp. ("PanAmSat") is currently licensed to operate PAS-8B from 43" WL utilizing the 12750 - 13250 MHz, 13750 - 14000 MHz and 10700 - 11450 MHz bands to provide service to various regions in the U S . and South America (See FCC File No.: SAT-LOA-19981029- 00084). In this filing, PanAmSat proposes to modify its license to specify operation of PAS-8B from 43.1" WL instead of 43" WL. To account for this change in orbital location, this engineering statement updates the following technical information that PanAmSat previously had submitted: (1) gain contours, (2) PFD levels and (3) link budget analysis. Gain Contours The coverage patterns of PAS-8B operating from the proposed 43.1 " WL orbital location will be the same as those specified in the current license. Changing the proposed orbital location from 43" WL to 43.1" WL will produce no visible change in the gain contours. Accordingly, no new beam gain contours are being submitted. Power Flux Density Levels The power flux density ("PFD") level at the Earth's surface produced by PAS-8B operating from the proposed 43.1" WL orbital location will be the same as those corresponding to operation from 43" WL and are presented in Exhibit 1 for the sake of completeness. Section 25.208 of the FCC Rules does not specify PFD limits for the frequency bands 10700 - 10950 MHz and 11200 - 11450 MHz. Accordingly, in Exhibit 1, the PFD is calculated only for the frequency band 10950 - 11200 MHz. Link Budgets and Interference Analysis The operational co-frequency satellites nearest to the 43.1" WL orbital location are PAS IR, located at 45" WL, and NSS-806, located at 40.5" WL. PAS 1R is licensed to PanAmSat and NSS-806 is licensed to New Skies Satellites ("NSS"). An earth station receiving transmissions from PAS 1R

and having antenna off-axis gain characteristics that are in compliance with the Section 25.209(a)(l) of the FCC Rules, would have an off-axis antenna gain of 21.5 dBi towards PAS-8B located at 43" WL. With PAS-8B operating from the proposed orbital location of 43.1" WL, the off-axis gain of the receiving earth station would be 22.0 dBi. Hence, there would be a resulting increase in the off-axis gain of the earth station antenna of 0.5 dB in the direction of PAS 1R. Such a small increase in the off-axis gain will not change in any meaningful way the existing interference environment of PAS 1R receiving earth stations from the proposed operation of PAS-8B at 43.1" WL. Similarly, interference from PAS 1R transmissions into PAS-8B receiving earth stations would be substantially unchanged (0.5 dB variation). With respect to an earth station receiving transmissions from NSS-806, the off-axis antenna gain of the receiving antenna would be reduced from 19.0 dBi to 18.6 dBi - a decrease of 0.4 dB. Such a small decrease in the off-axis gain of NSS-806 receive earth station will not change in any meaningful way the existing interference environment of NSS-806 receiving earth stations from the proposed operation of PAS-8B at 43.1" WL. Similarly, interference from NSS-806 transmissions into PAS-8B receiving earth stations would be substantially unchanged (0.4 dB variation). Given that the proposed operation of PAS-8B would not result in any significant change to the existing interference environment as it pertains to PAS-8B, PAS 1R and NSS-806, no link budget analysis is provided herein'. In the unlikely event that PAS-8B operating from 43.1" WL was to adversely affect the transmissions from NSS-806, PanAmSat would coordinate with NSS to reach a mutually acceptable solution2. Similarly, in the unlikely event that PAS 1R transmissions are affected as a result of the proposed operation of PAS-8B, PanAmSat would take appropriate actions to resolve the matter through internal coordination. Schedule S Submission For reasons that are discussed above, the proposed operation of PAS-8B from 43.1" WL would not result in any material changes to the operating 'The International Bureau recently clarified that GSO space station applicants generally are expected to provide this information. Based on this fact and on discussions with the staff of the Satellite Division, PanAmSat is not including a Schedule S with its modification application. By definition, these limitations do not apply to non-common carrier space station licenses held by PanAmSat Licensee Corp.

(”PanAmSat”)never has had an FCC license ”revoked.” However, on June 26,2000, the International Bureau ”cancelled” two Ka-band satellite authorizations issued to PanAmSat, based on the Bureau’s finding that PanAmSat LC had not satisfied applicable construction milestones. See In re PanArnSat Licensee Corp., Memorandum Opinion and Order, DA 00-1266, 15 FCC Rcd 18720 (IB 2000). In that same order, the Bureau denied related applications to modify the cancelled authorizations. PanAmSat filed an application for review of the Bureau’s decision, which the Commission denied, and subsequently filed an appeal with the United States Court of Appeals for the District of Columbia Circuit, which was dismissed in January 2003 at PanAmSat’s request. Notwithstanding the fact that the Bureau’s action does not seem to be the kind of revocation action contemplated by question 36, PanAmSat is herein making note of the decision in the interests of absolute candor and out of an abundance of caution. In any event, the Bureau’s action with respect to PanAmSat does not reflect on its basic qualifications, which are well-established and a matter of public record.
