Scope of Grant:       EchoStar is authorized to operate EchoStar—1 as an in—orbit spare using only telemetry,
                      tracking, and command (TT&C) frequencies.

Operations under this grant must comport with the legal and technical specifications set forth by the
applicant or petitioner and with Federal Communication Commission‘s rules not waived herein. This
grant is also subject to the following conditions:

    1. EchoStar must prepare the necessary information, as may be required, for submission to the International
       Telecommunication Union (ITU) to initiate and complete the advance publication, coordination, due
       diligence, and notification procedures of this space station, or other appropriate procedures under the ITU
       Radio Regulations. EchoStar will be held responsible for all cost recovery fees associated with ITU
       filings. No protection from interference caused by radio stations authorized by other administrations is
       guaranteed unless coordination, notification, or other appropriate procedures are timely completed or,
       with respect to individual administrations, coordination agreements are successfully completed. Any
       radio station authorization for which coordination or other appropriate procedures have not been
       completed may be subject to additional terms and conditions as required to effect coordination of the
        frequency assignments of other administrations, 47 CFR § 25.111(b).

       EchoStar must maintain the EchoStar—1 space station at the 77.25° W.L. orbital location with an east /
       west longitudinal station—keeping tolerance of + 0.05 degrees.

       EchoStar‘s request for waiver of Section 25.202(g) of the Commission‘s rules, 47 CFR § 25.202(g), is
        granted. Section 25.202(g) requires, among other things, that telemetry, tracking and command (TT&C)
       functions for U.S. domestic satellites be conducted at either or both edges of the allocated band(s).
       EchoStar—1‘s use of C—band frequencies for TT&C was initially authorized because it allowed EchoStar
       to "operate with greater reliability and lower cost, with no adverse impact on other operators." See
       EchoStar Satellite Corporation Applicationfor Modification of Construction Permitfor a Direct
       Broadcast Satellite System, 11 FCC Red 3016 (1996). Similarly, there is no adverse impact on other
       U.S.—authorized operators in the present case, but this waiver is conditioned on EchoStar coordinating the
       operations of EchoStar—1 with the operation of in—orbit satellites of U.S. and other affected
       administrations, and EchoStar coordinating its TT&C earth station operations with co—primary terrestrial
       services operating in the band.

       EchoStar‘s request for a waiver of Sections 25.114(d)(14)(ii) and 25.283(c), is granted. Section 25.283(c)
       specifies that space stations must discharge all stored energy sources at end—of—life of the space station.
       EchoStar—1 is a Lockheed—Martin AS—7000 spacecraft that was launched on December 28, 1995, before
       the rule was adopted. Applicant states that shortly following orbital insertion, the oxidizer tank was

          permanently isolated from the thrusters by firing pyrotechnic valves. Any oxidizer remaining in the
          oxidizer tank cannot be used or vented at end of life, and the applicant states that the satellite‘s design
          means that its fuel tanks cannot be completely depleted and will retain a residual amount of oxidizer and
          pressurant at the end of the life of the satellite. Applicant states that the volume of the oxidizer tank is
          642.86 litres (39230 cubic inches), and at end of life there will be 2.0 kilograms of helium and 4.1
          kilograms of oxygen remaining in the oxidizer tank. Compliance with Section 25.283(c) is not
          achievable except through direct retrieval of spacecraft. The information submitted is not sufficient to
          support a finding that the underlying purpose of Section 25.283(c) would be served.

 Licensee/grantee is afforded thirty (30) days from the date of release of this action to decline the grant as
 conditioned. Failure to respond within this period will constitute formal acceptance of the grant as conditioned.

 This action is taken pursuant to Section 0.261 of the Commission‘s rules on delegated authority, 47 CFR § 0.261,
 and is effective upon release.

 Station licenses are subject to the conditions specified in Section 309(h) of the Communications Act of 1934, as
 amended, 47 U.S.C. § 309(h).

 ‘ EchoStar filed a supplement to this application and requested a license term of approximately 5 years, rather than the 12—
 year license term indicated in the Schedule S, in order to match the expected end of life of EchoStar—1. In the supplement,
 EchoStar states that on June 17, 2016, EchoStar—1 "commenced inclined orbit operations to extend its mission life," and that
 the projected end of life for EchoStar—1 is also based on the amount of useable propellant remaining as of June 30, 2016, the
 300 km end—of—life disposal requirement, and the "fuel consumption rate for east—west station—keeping maintenance over the
