DISH Operating L.L.C. IBFS File No. SAT—LOA—20141002—00105 Call Sign $2931 The application of DISH Operating L.L.C. (DISH), IBFS File No. SAT—LOA—20141002—00105, IS GRANTED. Accordingly, DISH is authorized to construct, launch, and operate a geostationary orbit space station, to be known as EchoStar 18 (S2931), at the 109.9° W.L. orbital location to provide Direct Broadcast Satellite Service to the continental United States, Alaska, Hawaii, and Puerto Rico in the 12.2—12.7 GHz (space—to—Earth) and 17.3—17.8 GHz (Earth—to— space) frequency bands.‘ DISH is also authorized to conduct telemetry, tracking, and command (TT&C) operations necessary to maintain EchoStar 18 using the following center frequencies: 12.695 GHz, 12.696 GHz, 12.203 GHz, and 12.204 GHz (space—to—Earth), and 17.303 GHz (Earth—to—space). In addition, DISH may conduct command operations in the 17.791—17.796 GHz (Earth—to—space) frequency band. Operations under this authorization must be in accordance with the terms, conditions, and technical specifications set forth in DISH‘s application and the Federal Communications Commission‘s rules, and are subject to the following conditions: 1. Pursuant to Section 25.111(c) of the Commission‘s rules, 47 C.F.R. § 25.111(c), DISH must provide the Commission with all information it requires in order to modify the Appendix 30 BSS Plan and associated Appendix 30A feeder—link Plan to incorporate the characteristics of the BSS space station of the EchoStar 18 satellite, USABSS—41, in accordance with the ITU Radio Regulations. DISH shall be held responsible for all cost recovery fees associated with these ITU filings. We also note that no protection from interference caused by radio stations authorized by other administrations is guaranteed unless coordination and notification procedures are timely completed, or, with respect to individual administrations, coordination agreements are successfully completed. Any radio station authorization for which coordination has not been completed and/or for which the necessary agreements under Appendices 30 and 30A have not been obtained may be subject to additional terms and conditions as required to effect coordination or obtain the agreement of other Administrations. 2. EchoStar is also authorized to operate EchoStar 18 initially as an in—orbit spare for the EchoStar 10 space station (Call Sign $2694) at the 110.2° W.L. orbital location." In the event EchoStar operates EchoStar 18 as an in—orbit spare and subsequently activates the communications payload, EchoStar must notify the Commission, in writing, of activation of the communication payload within three business days of the start of the activation. 3. In connection with the provision of service in any particular country, DISH is obliged to comply with the applicable laws, regulations, rules, and licensing procedures of that country. 4. DISH must maintain the EchoStar 18 space station with an east/west longitudinal station—keeping tolerance of +/— 0.05 degrees of the 109.9° W.L. orbital location. ‘ Although DISH is authorized to construct and launch EchoStar 18 with the capability of operating on DBS channels 28, 30, and 32, DISH has not sought — and is not granted ~ authority to operate on DBS channels 28, 30, and 32 pursuant to this authorization. * EchoStar 10 (Call Sign $2694) operates at the 110.2° W .L. orbital location in the same frequency bands as EchoStar 18. In addition, EchoStar 11 (Call Sign $2738) operates at the 110.0° W.L. orbital location in the same frequency bands as EchoStar 18.
