         The application of DIRECTV Enterprises, LLC (DIRECTV), IBFS File No. SAT—LOA—
20120518—00085, is GRANTED.! Accordingly, DIRECTV is authorized to construct, launch, and
operate a Ka—band geostationary orbit (GSO) space station, DIRECTV 14 (Call Sign $2869), at the
99.235° W.L. orbital location." Specifically, DIRECTV is authorized to provide Fixed—Satellite Service
(FSS), including Direct—to—Home (DTH) services, using the 29.5—30.0 GHz (Earth—to—space) and the 19.7—
20.2 GHz (space—to—Earth) frequency bands on a primary basis. In addition, DIRECTV 14 is authorized
to use the following center frequencies for telemetry, tracking, and command (TT&C) operations for
DIRECTV 14 at the 99.235° W.L. orbital location: 28.351 GHz and 28.353 GHz, (Earth—to—space); and
18.799 GHz and 18.7995 GHz (space—to—Earth). DIRECTV is also authorized to use the 29.997 GHz
center frequency for beacon operations. Operations under this authorization must be in accordance with
the terms, conditions, and technical specifications set forth in DIRECTV‘s application, and the Federal
Communications Commission‘s rules not waived herein, and are subject to the following conditions:

         1.      DIRECTV must prepare the necessary information as may be required for submission to
the International Telecommunication Union (ITU) to initiate and complete the advance publication,
international coordination, due diligence, and notification process of this satellite system, in accordance
with ITU Radio Regulations. DIRECTV shall be held responsible for all cost recovery fees associated
with these ITU filings. We also note that no protection from interference caused by radio stations
authorized by other administrations is guaranteed unless coordination and notification procedures are
timely completed or, with respect to individual administrations, by successfully completing coordination
agreements. Any radio station authorization for which coordination has not been completed may be
subject to additional terms and conditions as required to effect coordination of the frequency assignments
with other administrations. See 47 C.F.R. § 25.111(b).

         2.      DIRECTV must maintain DIRECTV 14 with an east—west longitudinal station—keeping
tolerance of + 0.05 degrees of the 99.235° W.L. orbital location.

        3.       DIRECTV must coordinate its space—to—Earth operations in the 19.7—20.2 GHz frequency
band, as well as at the center frequencies 18.799 GHz and 18.7995 GHz, with U.S. Federal Systems,
including Federal operations to earth stations in foreign countries, in accordance with footnote US334 to
the United States Table of Frequency Allocations, 47 C.F.R. § 2.106.

         4.     The power flux—density (PFD) at the Earth‘s surface produced by the emissions from the
DIRECTV 14 space station for all atmospheric conditions, and for all methods of modulation, at the
center frequencies 18.799 GHz and 18.7995 GHz, and in the 19.7—20.2 GHz frequency band (space—to—
Earth), must not exceed a level of —118 dBW/m"*/MHz at any angle of arrival."

> DIRECTV plans to place this Ka—band payload on board a hybrid satellite that is already authorized to operate a
17/24 GHz BSS payload. The 17/24 GHz space station, known as DIRECTV RB—1, was authorized under Call Sign
$2711. DIRECTV Enterprises, LLC, IBFS File No. SAT—LOA—20060908—00099 (granted Jul. 28, 2009).

* Footnote US255 to the United States Table of Frequency Allocations, 47 C.F.R. § 2.106, requires that the PFD
across the 200 MHz of the 18.6—18.8 GHz band not exceed —95 dBW/m". DIRECTV proposes to operate the
DIRECTV 14 space station with a maximum PFD of —118 dBW/m°/MHz in this band. This level corresponds to a

        5.       DIRECTV 14‘s operations at the center frequencies 18.799 GHz and 18.7995 GHz
(space—to—Earth) are not entitled to protection from co—primary terrestrial services until the period during
which the terrestrial Fixed Service stations remain co—primary has expired. 47 C.F.R. § 25.145(g).

        6.      The DIRECTV 14 space station is added to the Ka—band Permitted List at the 99.235°
W.L. orbital location for the 29.5—30.0 GHz (Earth—to—space), and the 19.7—20.2 GHz (space—to—Earth)
frequency bands; however, until DIRECTV has completed coordination pursuant to Footnote US334 to
the United States Table of Frequency Allocations, 47 C.F.R. § 2.106, and both the FCC and the National
Telecommunications and Information Administration have approved the coordination, U.S.—licensed earth
stations are not permitted to communicate with the DIRECTV 14 space station in the 19.7—20.2 GHz
frequency band. See Revision of Part 25 Establishment of a Permitted List Procedure for Ka—band Space
Stations, Declaratory Order, 25 FCC Red 1542 (2010).

          7.      DIRECTV‘s request for a waiver of Section 25.114(d)(3) of the Commission‘s rules is
GRANTED. Section 25.114(d)(3) requires applicants to provide the predicted space station antenna gain
contour(s) for each transmit and each receive antenna beam and nominal orbital location requested.
DIRECTV has provided the required plots for the DIRECTV 14 receive and transmit antenna beams, but
states that the Schedule S software is unable to accommodate .gxt files for the number of beams on the
satellite. DIRECTV requests partial waiver of the Commission rule to submit the .gxt files directly to the
International Bureau staff in a GIMS container database file for inclusion in the record. DIRECTV has
also provided a graphical representation of the antenna gain contours for the on—station command (OSC)
and telemetry (OST) horns in Appendix B to the application, rather than the required .gxt format. We
find that the information submitted by DIRECTV is sufficiently complete to enable the Commission to
determine that the DIRECTV space station meets the rules technical requirements.

        8.       DIRECTV‘s request for waiver of Section 25.202(g) of the Commission‘s rules is
GRANTED. Section 25.202(g) requires FSS systems to operate their TT&C links at the edges of the
allocated frequency bands in which they are providing service. The bands allocated for Ka—band
GSO/FSS service are 18.3—18.8 GHz / 19.7—20.2 GHz (space—to—Earth), and 28.35—28.6 GHz / 29.25—30.0
GHz (Earth—to—space). DIRECTV requests authority to conduct TT&C at the edges of the allocated
GSO/FSS Ka—bands 18.3—18.8 GHz and 28.35—28.6 GHz, to allow it to better integrate the TT&C
frequencies for DIRECTV 14. DIRECTV 14 will be collocated with the SPACEWAY 2 and DIRECTV
11 space stations at the nominal 99° W.L. orbital location. DIRECTV states that the SPACEWAY 2
satellite has multiple command frequencies in the lower portion of the 29.5—30.0 GHz band, and
DIRECTV 11 has multiple command frequencies in the upper and lower edges of the 29.25—29.5 GHz
band.* In addition, DIRECTV 14 will incorporate a Radio Frequency Autotrack system in the upper
portion of the 29.5—30.0 GHz band. As a result, there is congestion at the available band edges. Because
DIRECTV is the only operator authorized to use Ka—band frequencies at this location, a waiver of the rule
will allow DIRECTV to use the TT&C frequencies for DIRECTV 14 within the existing infrastructure
and avoid the potential for interference between the signals of the co—located satellites.

9.       DIRECTV‘s request for a waiver of Section 25.210(i)(1) of the Commission‘s rules is
GRANTED. Section 25.210(i)(1) requires space station antennas in FSS systems to be designed to
provide a cross—polarization isolation such that the ratio of the on axis co—polar gain to the cross—polar
gain of the antenna in the assigned frequency band shall be at least 30 dB within its primary coverage
area. The minimum cross—polar isolation of the DIRECTV 14 satellite transmit and receive antennas is 27
dB. DIRECTV requests a waiver because the cross—polarization interference is an intra—system design
issue rather than an inter—system coordination, and that use of digital modulation with forward error
correction (FEC) coding on both polarization senses reduce the system sensitivity to cross—polarization
interference. DIRECTV also contends that optimizing polarization isolation, directivity and antenna
implementation losses allows a minimum isolation of 27 dB to be sufficient to avoid excessive levels of
intra—system interference and other Ka—band systems will not be affected by DIRECTV 14‘s operations.
We concur and find that a waiver is warranted. As a condition to the grant of this waiver, DIRECTV can
claim no more protection from interference from other licensed radio—communication systems operating
in accordance with the Commission‘s rules than it could claim if DIRECTV 14‘s operations complied
with Section 25.210(i)(1).

         10.      DIRECTV 14 must begin TT&C operations at 99.235° W.L. using center frequencies at
18.799 GHz (space—to—Earth), 18.7995 GHz (space—to—Earth), 28.351 GHz (Earth—to—space), and 28.353
GHz (Earth—to—space) before the DIRECTV 11 space station discontinues service at the nominal 99° W.L.
orbital location. Failure to meet this milestone shall render this authorization to operate in these
frequencies NULL and VOID.

         11.     DIRECTV 14 must begin providing service at 99.235° W.L. in the 29.5—30.0 GHz (Earth—
to—space) and 19.7—20.2 GHz bands (space—to—Earth) frequency bands before the Spaceway 2 space station
discontinues service at the nominal 99° W.L. orbital location. Failure to meet this milestone shall render
this authorization to operate in these frequency bands NULL and VOID.

        12.     The license term for the DIRECTV‘s DIRECTV 14 space station, Call Sign $2869, is 15
years and will begin to run on the date that DIRECTV certifies to the Commission that the space station
has been successfully placed into orbit and its operations fully conform to the terms and conditions of this
authorization. DIRECTV is directed to file this certification with the Chief, Satellite Division,
International Bureau, within 10 business days of DIRECTV 14 commencing operations at its assigned
location.

        13.     This authorization has no effect on, and is independent of, DIRECTV‘s license for the
DIRECTV RB—1 payload (Call Sign $2711).

        14.     DIRECTV is afforded 30 days from the date of the release of this authorization to decline
it, as conditioned. Failure to respond within this period will constitute formal acceptance of the
authorization, as conditioned.

        15.     This authorization is issued pursuant to Section 0.261 of the Commission‘s rules on
delegated authority, 47 C.F.R. § 0.261, and is effective immediately. Petitions for Reconsideration under
Section 1.106 or applications for review under Section 1.115 of the Commission‘s rules, 47 C.F.R. §§
1.106 and 1.115, may be filed within 30 days of the date of thepublic notice1ndlcat1ng that this action
