The request of 95 License Subsidiary, LLC (95 License Sub) for authority to construct, launch, and
operate a 17/24 GHz Broadcasting—Satellite Service (BSS) space station at the 95.15° W.L. orbital —
location, which is offset 0.15° from the 95.0° W.L. location specified in Appendix F to the 17/24 GHz BSS
Report and Order, FCC 07—76, 22 ECC Red 8842 (rel. May 4, 2007), IS GRANTED.‘ Accordingly, 95
License Sub is authorized to operate a 17/24 GHz BSS space station at the 95.15° W.L. orbital location
using the 17.3—17.8 GHz (space—to—Earth) and the 24.75—25.25 GHz (Earth—to—space) frequency bands,
with the 17.7—17.8 GHz (space—to—Earth) frequency band limited to international service only, in
accordance with the terms and conditions contained in its application, the Federal Communication
Commission‘s (Commission‘s) rules and the conditions of this attachment.
     1.       95 License Sub is authorized to operate its 17/24 GHz BSS space station at the 95.15° W.L.
              orbital location up to the maximum power flux density limits defined in Sections 25.208(c)
              and (w) of the Commission‘s rules, subject to the actual technical parameters in its
              application.

    2.        95 License Sub must maintain its 17/24 GHz BSS space station with an east/west longitudinal
              station—keeping tolerance of + 0.05 degrees of the assigned 95.15° W.L. orbital location.
    3.        95 License Sub, when designing its system, is reminded to take into consideration the
              geographic service requirements of Section 25.225 of the Commission‘s rules. 47 C.F.R. §
              25.225.

    4.        95 License Sub‘s 17/24 GHz BSS space station at the 95.15° W.L. orbital location must be
              constructed, launched, and placed into operation in accordance with the technical parameters
              and terms and conditions of this authorization by these specified time periods following the.
              date of authorization:

              a.   Execute a binding contract for construction within one year (August 30, 2012);
              b.   Complete the Critical Design Review within two years (August 30, 2013);
              c.    Commence construction within three years (August 30, 2014);

‘ Initially, 95 Licensee requested authority to construct, launch, and operate a space station at the 95.0° W.L. orbital
location. The application was placed on Public Notice as accepted forfiling on October 2, 2009. Policy Branch
Information, Satellite Space Applications Accepted for Filing, Public Notice, Report No. SAT—00636 (rel. Oct. 2,
2009). Comments were filed by Hughes Network Systems, LLC (Hughes) and SES Americom Inc. (SES) on
November 2, 2009. No petitions to deny were filed. SES‘s comments request imposition of a standard international
coordination condition, which is included in this grant as condition 6. Hughes‘ comments expressed concern about
the possibility of physical coordination of 95 License Sub‘s space station with a Hughes space station that is
authorized to operate at 95.0° W.L. Hughes‘ concern was resolved by 95 License Sub‘s amendment to offset its
orbital location from 95.0° W.L. to 95.15° W.L. The amended application was placed on Public Notice as accepted
for filing on May 20, 2011. One comment was filed by Hughes stating that it fully supports grant of the application
at the modified orbital location. Comments of Hughes Network Systems, LLC, filed June 13, 2011. No other
comments were filed. We note that 95 License Sub requested waiver of Section 25.116 of the Commission‘s rules,
47 CE.R. § 25.116, to the extent necessary, to avoid a potential loss of position in the processing queue. We need
not address the waiver request in order to grant this application because no other 17/24 GHz BSS applications were
filed that might affect 95 Licensee‘s place in the Commission‘s processing queue. Accordingly, we dismiss the
waiver request as moot.


              d.   Launch and begin operations within five years (August 30, 2016); and
              e.   95 License Sub must file a bond with the Commission in the amount of $3 million,
                   pursuant to the procedures set forth in Public Notice, DA 03—2602, 18 FCC Red 16283
                   (2003), within 30 days of the date of this grant (September 29, 2011).

                   Failure to meet any of these dates shall render this authorization null and void.

              This authorization and all conditions contained herein are subject to the outcome of the
              Commission‘s rulemaking in IB Docket No. 06—123 and any requirements subsequently
              adopted therein. Such additional requirements include, but are not limited to, those contained
              in FCC 11—93 (rel. June 14, 2011) upon the effective date(s) of the new rules.

              95 License Sub must prepare all necessary information that may be required for submission
              to the International Telecommunication Union (ITU) to initiate and complete the advance
              publication, international coordination, due diligence, and notification procedures for this
              space station, in accordance with the ITU Radio Regulations. 95 License Sub shall be held
              responsible for all cost recovery fees associated with these ITU filings. No protection from
              interference caused by radio stations authorized by other Administrations is guaranteed unless
              coordination and notification procedures are timely completed or, with respect to individual
              Administrations, by successfully completing coordination agreements. Any radio station
              authorization for which coordination has not been completed may be subject to additional
              terms and conditions as required to effect coordination of the frequency assignments with
              other Administrations. 47 C.F.R. § 25.111(b).

              95 License Sub must submit to the Commission the information required by No. 9.1 of the
              ITU Radio Regulations for advance publication of its 17/24 GHz BSS space station at the
              95.15° W.L. orbital location no later than 60 days from the date of this action. 95 License
              Sub must submit to the Commission the information required by Section II of Article 9 of the
              ITU Radio Regulations for the request for coordination ofits 17/24 GHz BSS space station at
              the 95.15° W.L. orbital location no later than 240 days from the date of this action. The
              information submitted in compliance with this condition must be submitted to the
              Commission via email to chip.fleming@fec.gov and kathyra.medley@fee.gov .

              The license term for this 17/24 GHz BSS space station, Call Sign $2795, is 15 years and will
              begin to run on the date that 95 License Sub certifies to the Commission that the satellite has
              been successfully placed into orbit and its operation fully conforms to the terms and
              conditions of this authorization. 47 C.F.R. § 25.121(a). 95 License Sub must file this
              certification with the Chief, Satellite Division, International Bureau, within ten business days
              of the space station being put into operation.

              On June 30 of each year, 95 License Sub must file a report with the International Bureau and
              the Commission‘s Columbia Operations Centerin Columbia, Maryland, containing the
              information current as of May 31 of that year pursuant to Section 25.210(1) of the
              Commission‘s rules. 47 C.F.R. § 25.210(1).

        10.   95 License Sub is afforded 30 days from the date of release of this grant to decline this
              authorization as conditioned. Failure to respond within this period will constitute formal
              acceptance of the authorization as conditioned.
