Dear Ms. Dortch:

        DIRECTV Enterprises, LLC (“DIRECTV”) hereby submits additional information to
facilitate the staff’s review of DIRECTV’s compliance with its milestone requirements to
execute a non-contingent satellite contract and to complete the critical design review (“CDR”)
for the DIRECTV RB-1 satellite. DIRECTV previously submitted its construction contract with
Space Systems/Loral (“SS/L”) on July 26, 2010, and materials demonstrating completion of
CDR on July 28, 2011.

         The SS/L contract contemplates a satellite with both a 17/24 GHz BSS payload and a Ka-
band payload. Although DIRECTV currently operates two Ka-band satellites at the nominal 99°
W.L. orbital location, it has not yet sought authorization for the Ka-band payload on this
satellite. DIRECTV is in the process of finalizing various design and operational details, and
intends to file an appropriate application with the Commission for such authority in the next few
months. Accordingly, DIRECTV recognizes that, as contemplated under Section 25.113(f) of
the Commission’s rules, it is proceeding with construction of the satellite at its own risk. In
addition, DIRECTV recognizes that any favorable finding with respect to the contracting and
CDR milestones would not be tantamount to approval of any technical specifications in addition
to or not consistent with DIRECTV’s existing authorization. DIRECTV also accepts the risk
that design changes might be required in light of any future Commission action with respect to
an application for authorization of the Ka-band payload on this satellite.

       Lastly, this is to confirm that to date, DIRECTV has paid SS/L all amounts due under the
Milestone Payment Plan attached as Exhibit E to the contract through Payment Milestone 14b.
