 Dear Mr. Park:
         On July 28, 2004, AfiSpace, Inc.(*AfriSpace") fled the above—captioned application for
 suthority to launch and operate AfriStar—2 atthe at 21° EL. orbital lcation. For the reasons discussed
 below, we dismiss the appliation asdefective, without prejudicet refiling
          AfriStar2 will provide broadcastig—satelite service (sound) in the 1452—1492 MHz band." It
 will also operate feederlinks in the 7025—7075 MHz band? The 7025—7075 MHz band is allocated on a
 primary basis to the Aixed—satellite servicein TTU Regions 1, 2and 3, and to no other stelite servic."
 "The definition of "Tixed—satelteserviee         Seetion 25.201 of the Commission‘s rules* includes eeder
 links of other space radiocommunication services."
          In the "Antenna Beams" section of Schedule S of ts application,in tem $7.(q),AftiSpace states
 thatit plans to launch and operate AfriStar—2 with a maximum input attenuator value of dB. Section
 25.210()of the Commission‘s ules® requires fixed.—satllit service space stations to have a minimum
 capabiliy t change transponder saturtion flux densitiesby ground commund in 4 dB steps over a range
 of 12 dB. Thus, AfriSpace‘s proposed feeder links do not comply with the Commission‘s rules.
 Moreover, AfriSpace has not requested a waiver of Section 25.210(c). Sections 25.1 12@@)2)and (b)(1)
 of the Commission‘srulesstate that an application that does not substantially comply with the
 Commission‘s rules will be returmed to the applicant as unacceptable for filing unlessthe application is

accompanied by a waiver requestwith reasons supportingthe waiver. Therefore, we find AfriSpace‘s
application defective and retum it without prejudice to refling.
        Accordingly, pursuant to the Commission‘s rules on delegated authority, 47 CFR. $ 0.261(@)(9
we find that this application, File No. SAT—LOA—20040728—00150, is defective. We therefore dismiss the
application without prejudiceto refilig."
