                Pursuant to Paragraph 39 ofthe Order and Authorization forthe above—referenced
EchoStar—121 W—KuX satellie, DA 04—3164 (granted Sept. 30, 2004, corrected Oct. 20, 2004), EchoStar
Satellte LLC. ("EchoStar") is required to submit an in—orbit collsion avoidance statement within 60
days of grant. On November 2, 2004, EchoStar filed an application to modify ts authorization for this
satellte, which included such a statement in the Technical Annex, See SAT—MOD—20041102—00206,
Exhibit 1, at page A—11). To the best of EchoStar‘s knowledge, tat in—orbit collision avoidance
statement remains accurate.
