Dear Ms. Dortch:

       On April 20, 2009, EchoStar Corporation ("EchoStar") was granted authority to construct,
launch and operate a new satellite over the 17/24 GHz Broadcasting—Satellite Service spectrum at 79°
W.L. See Stamp Grant, File Nos. SAT—LOA—20020328—00050, SAT—AMD—20050118—00247, SAT—
AMD—20080114—00018, SAT—AMD—20080213—00044 (granted Apr. 20, 2009). EchoStar is hereby
submitting all the information required to request ITU coordination for the authorized satellite network.
EchoStar will also be held responsible for any cost recovery fees associated with this ITU filing.

       EchoStar hereby submits a computer disk containing a zip file, which provides all of the
information required to request coordination for the above referenced satellite network. Additionally,
EchoStar is submitting a letter accepting responsibility for any cost recovery fees associated with the
ITU filings. See Attachment A.

Dear Ms. Dortch:

       This letter is submitted on behalf of EchoStar Corporation ("EchoStar") in connection with
EchoStar‘s proposed satellite network USABSN—21 at 79° W.L. See Stamp Grant, File Nos. SAT—LOA—
20020328—00050, SAT—AMD—20050118—00247, SAT—AMD—20080114—00018, SAT—AMD—20080213—
00044 (granted Apr. 20, 2009).

        EchoStar is aware that as a result of the actions taken at the 1998 Plenipotentiary Conference,
processing fees will now be charged by the International Telecommunication Union ("ITU®") for satellite
network filings. As a consequence, Commission applicants are responsible for any and all fees charged
by the ITU. EchoStar hereby states that it is aware of and unconditionally accepts this requirement and
its responsibility to pay any ITU cost recovery fees associated with the aforementioned ITU filing in a
timely manner. In addition, all correspondence with EchoStar regarding ITU cost recovery issues
should be directed to the undersigned.
