The application of PanAmSat Licensee Corp. (PanAmSat), IBFS File No. SAT—MOD—
20090720—00073, as amended by SAT—AMD—20090820—00091 and SAT—AMD—20091113—
00122, for authority to operate the Intelsat 1R space station (Call Sign $2368) at the 50.0°
W.L. orbital location IS GRANTED.‘ Accordingly, PanAmSat is authorized to provide
Fixed—Satellite Service (FSS) via the Intelsat 1R space station in the 3700—4200 MHz
(space—to—Earth), 5925—6425 MHz (Earth—to—space), 10.95—11.20 GHz (space—to—Earth),
11.45—11.95 GHz (space—to—Earth), and 13.75—14.50 GHz (Earth—to—space) frequency bands
from the 50.0° W.L. orbital location. In addition, PanAmSat is authorized to conduct
telemetry, tracking, and telecommand (TT&C) operations for the Intelsat 1R space station
using the following frequencies: 13.995 GHz (horizontal and vertical polarization) and
14.4985 GHz (left—hand circular polarization) (Earth—to—space), 11.696 GHz (horizontal,
vertical and left—hand circular polarization) and 11.697 GHz (horizontal, vertical and left—
hand circular polarization) (space—to—Earth). This authorization is granted in accordance
with the technical specifications set forth in PanAmSat‘s application, as amended, the rules
of the Federal Communication Commission (Commission), and the following conditions:

        1.     PanAmSat shall operate the Intelsat 1R space station at the 50.0° W.L. orbit
location in compliance with all existing or future coordination agreements for that location.

       2.      PanAmSat shall maintain Intelsat 1R within an east—west longitudinal
station—keeping tolerance of + 0.05° of its assigned 50.0° W .L. orbital location.

       3.      In connection with the provision of service in any particular country,
PanAmSat is obliged to comply with the applicable laws, regulations, rules, and licensing
procedures of that country.

        4.      PanAmSat‘s request for waiver of Section 25.210(a)(3) of the
Commission‘s rules, 47 CFR. § 25.210 (a)(3), is granted. Section 25.210(a)(3) requires
all FSS space stations used for domestic service in the 3700—4200 MHz and 5925—6425
MHz bands to be capable of switching polarization sense upon ground command. The
Commission requires polarity—switching capability for two reasons: (1) to provide U.S.—
licensed satellites with the flexibility to operate at different orbital locations, and (2) to
mitigate potential interference between adjacent fixed—satellite systems transmitting analog
television signals." This waiver is based upon a finding that the ability to switch

polarization is not currently necessary to protect other satellites at adjacent orbital locations
from harmful interference, because the only C—band space station operating within three
degrees of PanAmSat‘s proposed location is operated by Intelsat (Intelsat 707 at 53.0°
W.L.) and because the Intelsat 1R space station operations will be in compliance with
existing coordination agreements. As a condition of this waiver, PanAmSat must
accommodate future satellite networks that are compliant with Section 25.210(a)(3).
Further, PanAmSat must operate Intelsat 1R pursuant to any existing or future coordination
agreements for this location.

         5.     PanAmSat‘s request for waiver of Section 25.211(a) of the Commission‘s
rules, 47 C.F.R. § 25.211(a), is granted. Section 25.211(a) requires that downlink analog
video transmissions in the 3700—4200 MHz band be transmitted only on a center frequency
of 3700+20N MHz, where N=1 to 24. The corresponding uplink frequency shall be 2225
MHz higher. PanAmSat states that Intelsat 1R utilizes 36 MHz and 72 MHz wide
transponders, and that the placement of TV/FM signals within the 72 MHz might result in
non—compliance with Section 25.211(a). Because the closest co—frequency satellite to
Intelsat 1R is Intelsat 707 at 53° W.L., PanAmSat states that it will be able to internally
coordinate Intelsat 1R‘s TV/FM transmissions with Intelsat 707. As a condition of this
waiver, PanAmSat must accommodate future satellite networks that are compliant with
Section 25.211(a). Further, PanAmSat must operate Intelsat 1R pursuant to any existing or
future coordination agreements for this location.

         6.     PanAmSat‘s request for waiver of Section 25.114(d)(3) of the
Commission‘s rules, 47 C.F.R. § 25.114(d)(3), is granted. Section 25.114(d)(3) requires
that the space station antenna gain contour(s) for each transmit and receive antenna beam
should be plotted on an area map at 2 dB intervals down to 10 dB below peak value of the
parameter and at 5 dB intervals between 10 dB and 20 dB below peak values. PanAmSat
requested a waiver with respect to Intelsat 1R‘s TT&C bicone antenna beams because the
satellite manufacturer does not provide the beam patterns in the required form. As a
substitute, PanAmSat provided a descriptive characterization of these beams along with the
beam patterns provided by the manufacturer. We find that the manufacturer—provided
beam patterns combined with PanAmSat‘s descriptive characterization of the TT&C
bicone antenna beams are sufficient to fulfill the informational requirements of Section
25.114(d)(3) and sufficient to grant a waiver of this rule.

         7.     PanAmSat is authorized to use 13.995 GHz for command of the Intelsat 1R
space station. No waiver of Section 25.202(g) is required to authorize the use of these
frequencies for command functions. See Northrop Grumman Space & Mission Systems
Corp., Order and Authorization, 24 FCC Red 2330, 2362 (para. 95) (Int‘l Bur. Feb. 24,
2009).

        8.    PanAmSat‘s request for waiver of Sections 25.114(d)(14)(ii) and 25.283(c)
of the Commission‘s rules, 47 C.F.R. §§ 25.114(d)(14)(ii) and 25.283(c), is granted, as
conditioned herein. These rules require an applicant to demonstrate that all stored energy

 will be vented at the spacecraft‘s end of life. PanAmSat indicates that Intelsat 1R is a
 Boeing model 702 spacecraft that is not designed to vent all of its pressurized systems.
 The spacecraft was launched November 16, 2000, prior to the adoption of these rules, and
 compliance would require direct retrieval of the spacecraft.

         9.      PanAmSat shall notify the Chief, Satellite Division, in writing, within five
 days of any anomaly experienced by the xenon ion propulsion system (XIPS) that results
 in cessation of XIPS operations, or that might reasonably be expected to result in
 cessation of XIPS operations, or that might otherwise compromise the reliability of end—of—
 life disposal using the XIPS. Within 15 days following any such anomaly, PanAmSat shall
 submit a revised post—mission disposal plan for the spacecraft, and provide full information
 with respect to the standard chemical propulsion system, including fuel reserved for end—
 of—life operations and methods for addressing fuel gauging uncertainty of that system.

        10.     PanAmSat‘s request for continued waiver of Section 2.106, Footnote
 NG104 to the U.S. Table of Frequency Allocations, 47 C.F.R. § 2.106, and footnote 2 of
 Section 25.202(a)(1) of the Commission‘s rules, 47 C.F.R. § 25.202(a)(1), in order to
 provide domestic service using earth stations that receive in the 10.95—11.20 GHz and
 11.45—11.70 GHz bands is granted. Waiver of these rule provisions was previously granted
 to permit the provision of domestic service via the Intelsat 1R space station at 43.1° W .L.
 See PanAmSat Licensee Corp., Application for Authority to Use Extended Ku—band
 Frequencies for Domestic Service, Order and Authorization, 20 FCC Red 14642 (Int‘l
 Bur., Sat. Div. 2005). We find that the same public interest considerations that justified
 waiver for operations at 43.1° W.L. continue to apply for operations of Intelsat 1R at 50.0°
 WL.

         11.    PanAmSat shall operate its earth stations in the 10.95—11.20 GHz and
  11.45—11.70 GHz bands that provide domestic service on an unprotected, non—interference
 basis relative to fixed stations and, as such, PanAmSat may not cause harmful interference
 to, or claim protection from, fixed stations to which frequencies in the 10.95—11.20 GHz
 and 11.45—11.70 GHz bands have either already assigned, or to which frequencies in the
 10.95—11.20 GHz and 11.45—11.70 GHz bands may be assigned at a later date.

          12.    PanAmSat is required to inform its customers, in writing, including end—
  users receiving service from resellers accessing capacity on the Intelsat 1R space station,
  that domestic service in the 10.95—11.20 GHz and 11.45—11.70 GHz bands is being
  provided on an uncoordinated basis, and that the potential exists that future—licensed fixed
— stations may cause harmful interference to these unprotected earth stations.

         13.     PanAmSat‘s use of the 10.95—11.20 GHz and the 11.45—11.70 GHz band is
 subject to footnote US211 to the United States Table of Frequency Allocations, 47 CFR.
 § 2.106, US211, which urges applicants for airborne or space station assignments to take

all practicable steps to protect radio astronomy observations in the adjacent bands from
harmful interference, consistent with footnote US74.

        14.     In the 13.75—14.00 GHz band, receiving space stations in the fixed—satellite
service shall not claim protection from radiolocation transmitting stations operating in
accordance with the United States Table of Frequency Allocations.

         15.     Pursuant to footnote US337 of the United States Table of Frequency
Allocations, 47 C.F.R. § 2.106, any earth station in the United States and its possessions
communicating with the Intelsat 1R space station in the 13.75—14.00 GHz band is required
to coordinate through National Telecommunications and Information Administration‘s
(NTIA‘s) Interdepartment Radio Advisory Committee‘s (IRAC‘s) Frequency Assignment
Subcommittee (FAS) to minimize interference to the National Aeronautics and Space
Administration Tracking and Data Relay Satellite System, including manned space flight.

        16.    Operations of any earth station in the United States and its possessions
communicating with the Intelsat 1R space station in the 13.75—14.00 GHz band shall
comply with footnote US356 to United States Table of Frequency Allocations, 47 C.F.R. §
2.106, US356 which specifies a mandatory minimum antenna diameter of 4.5 meters and a
non—mandatory minimum and maximum equivalent isotropically radiated powers (e.i.r.p.).
Operations of any earth station located outside the United States and its possessions
communicating with the Intelsat 1R space station in the 13.75—14.00 GHz band shall be
consistent with footnote 5.502 to the ITU Radio Regulations, which allows a minimum
antenna diameter of 1.2 meters for earth stations of a geostationary satellite orbit network
and specifies mandatory power limits.

        17.   Operations of any earth station in the United States and its possessions
communicating with the Intelsat 1R space station in the 13.77—13.78 GHz band shall
comply with footnote US357 to United States Table of Frequency Allocations, 47 CFR. §
2.106, US357, which specifies that a required maximum e.1.r.p. density of emissions not
exceed 71 dBW in any 6 MHz band for communications with a space station in
geostationary—satellite orbit." Operations of any earth station located outside the United
States and its possessions communicating with the Intelsat 1R space station in the 13.77—
13.78 GHz band shall comply with footnote 5.503 to the ITU Radio Regulations, which
specifies a required maximum e.i.r.p. density of emissions (limit is dependent on antenna
diameter) for communications with a space station in geostationary—satellite orbit.

       18.    Operators of earth stations accessing the Intelsat 1R space station in the
13.75—14.00 GHz band are encouraged to cooperate voluntarily with the National

Aerdnautics and Space Administration (NASA) in order to facilitate continued operation of
NASA‘s Tropical Rainfall Measuring Mission (TRMM) satellite.*

         19.      Grant of this authorization does not constitute a finding pursuant to Section
25.161(c) of the Commission‘s rules.

        20.     Grant of this authorization is without prejudice to any decision regarding
PanAmSat‘s ability to file an application for authorization to operate a replacement space
station in the 10.95—11.20 GHz, and 13.75—14.00 GHz frequency bands at the 45° W.L.
orbital location.‘ Grant of this authorization does not constitute an announcement that
these frequencies are available for reassignment.

        21.     PanAmSat‘s operation of the 3700—4200 MHz, 5925—6425 MHz, 10.95—
11.20 GHz, 11.45—11.95 GHz, and 13.75—14.50 GHz frequency bands at the 50.0° W .L.
orbital location is subject to the following conditions:

               a. PanAmSat shall remain a signatory to the Public Services Agreement
                  between Intelsat and the International Telecommunications Satellite
                  Organization (ITSO) that was approved by the ITSO Twenty—fifth
                  Assembly of Parties, as amended.

               b. No entity shall be considered a successor—in—interest to PanAmSat under the
                  ITSO Agreement for licensing purposes unless it has undertaken to perform
                  the obligations of the Public Services Agreement approved by the Twenty—
                  fifth Assembly of Parties, as amended.




* NASA‘s TRMM satellite system radar in the 13.793—13.805 GHz band remains operational and is a highly
valuable and visible United States asset with a broad range of international users. Accordingly, NTIA has
requested cooperation from the Commission and non—Federal Government entities in providing assistance in
reducing interference with the TRMM radar. Specifically, NTIA requests that FSS earth stations in the
13.793 — 13.805 GHz band located south of 39° N. and east of 110° W. operate with emission levels below —
150 dBW/600 kHz at the TRMM space station receiver. Letter from Frederick R. Wentland, Acting
Associate Administrator, Office of Spectrum Management, NTIA, to Don Abelson, Chief, International
Bureau, FCC (February 28, 2002). Considering the secondary nature of the TRMM operation, NTIA‘s
request is not a condition of this authorization. The Commission, however, urges all operators of earth
stations accessing the Intelsat 25 space station in the 13.75 — 14.0 GHz band to cooperate voluntarily with
NASA in order to facilitate continued operation of the TRMM satellite.

authorization for Intelsat 14, PanAmSat did not apply for, and was not granted, authorization to use the
10.95—11.2 GHz and 13.75—14.0 GHz frequency bands, which were authorized for use by Intelsat 1R at 45 °
W.L. See id. n.1.

authorization to decline this authorization as conditioned. Failure to respond within this
period will constitute formal acceptance of the authorization as conditioned.

reconsideration under Section 1.106 or applications for review under Section 1.115 of the
