        Intelsat North America LLC‘s (Intelsat North America) request for modification, File No.
SAT—MOD—20060407—00039, as amended by SAT—AMD—20060803—00084 and SAT—AMD—
20060922—00112, IS GRANTED. Accordingly, Intelsat North America is AUTHORIZED to
relocate the Intelsat Americas—5 (IA—5) satellite from its current location at 97° W.L. to 76.70°
W.L., upon the launch of the Intelsat Americas—9 (IA—9) satellite into the 97° W.L. orbital
location and completion of traffic transfer from IA—5 to IA—9. Intelsat North America is
authorized to operate the IA—5 satellite in the C—band (5925—6425 MHz and 3700—4200 MHz ) and
Ku—band (14.0—14.5 GHz and 11.7—12.2 GHz ) frequencies at the 76.70° W.L. orbital location, in
accordance with the terms, conditions, and technical specifications set forth in its applications,
this Attachment and the Federal Communication Commission‘s (Commission) Rules.

    1. During the drift of the IA—5 satellite from 97° W.L. to 76.70° W.L., Intelsat North
       America shall not operate the communications payload on the satellite.

        Intelsat North America shall coordinate all of its Tracking, Telemetry, Command &
        Monitoring (TTC&M) operations with in—orbit geostationary satellites to ensure that no
        unacceptable interference results from IA—5‘s TTC&M operations during its drift from
        97° W.L. to 76.70° W.L.

        During the drift, no harmful interference shall be caused by the IA—5 satellite to any other
        lawfully operating in—orbit satellite, and operations of the IA—5 satellite shall cease
        immediately upon notification of such interference.

       During the drift, Intelsat North America is required to accept interference from other
       lawfully operating in—orbit satellites.

       Intelsat North America shall operate the IA—5 satellite at the 76.70° W.L orbital location
       in a manner that does not exceed the limits in any existing coordination agreements
       designed to protect other satellite networks from potential interference caused by a
       satellite operating at the 77.0° W.L. orbital location.

       Intelsat North America‘s operations at the 76.70° W.L orbital location are subject to
       Article 22 of the International Telecommunication Union (ITU) Radio Regulations.

       Intelsat North America shall prepare the necessary information, as may be required, for
       submission to the ITU to initiate and complete the advance publication, international
       coordination, due diligence, and notification process of this space station, in accordance
       with the ITU Radio Regulations. Intelsat shall be held responsible for all cost—recovery
       fees associated with these ITU filings. We also note that no protection from interference
       caused by radio stations authorized by other administrations is guaranteed unless
       coordination and notification procedures are timely completed or, with respect to
       individual administrations, by successfully completing coordination agreements. Any
       radio station authorization for which coordination has not been completed may be subject


to additional terms and conditions as required to effect coordination of the frequency
assignments of other administrations. See 47 C.F.R. §25.111(b).

All other terms and conditions in the license for the IA—5 satellite, as modified by
subsequent Commission action remain in effect. See IBFS File No.: SAT—L/A—
19970411—00030.

This action is issued pursuant to Section 0.261 of the Commission‘s rules on delegated
authority, 47 C.F.R. § 0.261, and is effective upon release. Petitions for reconsideration
under Section 1.106 or applications for review under Section 1.115 of the Commuission‘s
rules, 47 C.F.R. §§ 1.106, 1.115, may be filed within 30 days of the date of the public
notice indicating that this action was taken.
