Dear Bob, I refer to the informal common understandings of our respective administrations set out in an exchange of letters on June 21, 2005 and June 22, 2005 respecting the EchoStar 5 satellite. In accordance with understanding 3 of the letter from the Federal Communications Commission, I wish to inform you that Ciel Satellite Communications expects to bring its Ciel—2 satellite into use at the 129W orbital position between January 15, 2009 and January 30, 2009. When the traffic has been moved from the EchoStar 5 to the Ciel—2 satellite, the EchoStar 5 satellite is expected to depart the 129W orbital position. This latter event is expected to occur between January 31, 2009 and February 15, 2009 under the direction and control of EchoStar, and we understand that the satellite will be relocated to the 148W orbital position. Pursuant to our informal understanding, when the EchoStar 5 satellite departs from the 129W orbital position, the United States would once again be the licensing administration and Ciel Communications would no longer hold a Canadian radio licence for the Echostar 5 satellite. We will keep you informed of any changes to this anticipated schedule. Best wishes for the New Year!
