Attachment 1 The application is entitled to receive streamlined treatment under the Commission’s rules because: (1) The Applicant is not a foreign carrier. The Applicant is affiliated with VueTel Italia S.P.A. (“VueTel Italia”), which is a licensed carrier in Italy, through joint ownership by VueTel Italia Holding S.P.A. (“Holding”). Holding owns 100% of the Applicant and also owns 100% of VueTel Italia. VueTel Italia only began operations as a carrier in Italy in 2009. Its voice service business in Italy and all around the world is always at the wholesale level, providing service only to other carriers and operators. VueTel Italia does not originate or terminate voice traffic directly or provide any retail voice service to individual or businesses costumers in Italy or any other country. VueTel Italia does not provide retail data services to businesses or individuals, although beginning in the second half of 2015, it will provide data services (such as international IP transit, international leased lines, VPN) to the wholesale and business retail market in Italy and on an international basis. VueTel Italia has less than one percent of the market for international telecommunications services, including in the international transport and the local access markets, in Italy. Italy is a WTO Member country and the Applicant and its affiliate qualify for a presumption of non-dominance under § 63.10(a)(3) and (4) because of the lack of market power demonstrated by VueTel Italia’s small market share. (2) The applicant has no affiliation with a dominant U.S. carrier whose international switched or private line services the applicant seeks authority to resell (either directly or indirectly through the resale of another reseller’s services). 1
