ATTACHMENT  2       1.  opticAccess, LLC’s (the Applicant) membership interests are held by five members, two of which hold more than 10%. AmCap Telecom Partners, LLC, a Delaware limited liability company, owns approximately 69% of the Applicant’s membership interests; and Cascade Divide Communications, Inc., a Washington corporation, owns approximately 16% of the Applicant’s membership interests. There is no individual member of AmCap Telecom Partners, LLC that is attributed with more than 10% ownership of opticAccess. Mr. John Warta, a U.S. citizen, whose address is 421 C Street, Washougal, WA 98671 and whose principal business is telecommunications, through intervening entities that he owns or controls, holds ultimate beneficial ownership of approximately 59% of Cascade Divide Communications, Inc. and therefore is attributed with Cascade Divide Communications’ 16% ownership of opticAccess. Mr. Jeffrey Mayhook, a U.S. citizen, is a director of Cascade Divide Communications and its parent company, Cascade Divide Enterprises, Inc., (a British Columbia corporation) and is also a member of the Board of Managers of the Applicant. Mr. Craig Atchison, a U.S. citizen, is a member of the Board of Managers of both AmCap Telecom Partners, LLC and the Applicant. This  is  in   response  to  Question  14.     2.    Applicant  has  not  previously  received  authority  under  Section  214  of  the  Act.     This  is  in  response  to  Question  15.       3.    Applicant  will  comply  with  the  terms  and  conditions  contained  in  Sections  63.21,   63.22  and  63.23  of  the  Commission’s  Rules.    47  C.F.R.  63.21,  .22  and  .23.    This  is  in   response  to  Question  15.         4.    Applicant  respectfully  requests  authority  to  operate  as  a  facilities-­‐based  carrier   pursuant  to  Section  63.18(e)(1)  and  a  resale  carrier  pursuant  to  Section  63.18(e)(2).   The Applicant will use previously authorized facilities to provide the services requested by the Application. Consequently, the Applicant is categorically excluded from environmental assessment pursuant to Section 1.1306 of the Commission's Rules. 47 C.F.R. 1.1306.  This  is  in  response  to  Question  15.
