("VarTec‘"), please find five (5) copies of this information update for the Commussion‘s review and records. On November4, 2004, VarTec notified the Commission of its bankruptcy status pursuant to §63.24. The Company‘s original correspondence reflected that VarTec as well as two ofits telecommunications subsidiaries, Excel Telecommunications, Inc. ("Excel"), and VarTec Solutions, Inc. f/k/a eMeritus Communications, Inc. ("VarTec Solutions"), had voluntarily filed for Chapter 11 bankruptcy in the Dallas Divisionof the United States Bankruptcy Court for the Northern District of Texas under Case No. 04—81694—SAF—11 as of November 1, 2004. Throughout the bankruptcy, VarTec and Excel have continued to provide competitive local exchange services to customers throughout the United States, and VarTec (ITC—90—152), Excel (ITC—93—145) and VarTec Solutions (ITC—97—227) continue providing intrastate, interstate and international long distance services to customers across the United States. VarTec again confirms that this voluntary bankruptcy filing has not resulted in a change of control or ultimate ownership for the Companies, and VarT‘ec commits that it will seek the Commission‘s approval prior to making any ownership change.
