Terry:

We have reviewed your request for XM to FCC ID inside the battery compartment. At the present time we are reviewing our
policies for label placement for such devices. At the present time, given the circumstances you describe, we would allow XM to
place the labels in the battery compartment, at least on an interim basis.

We expect to finalize our review of a long term policy soon. In order to expedite processing of the applications, I have copied this
message to Tim Johnson of ATCB.

         Hi Rashmi,

         One last question that just surfaced with the TCB involves label placement. Historically, XM has
         placed the FCC ID inside the battery compartment, underneath the batteries but not on the
         cover. ATCB says that FCC Lab permission is now required for labels placed in the battery
         compartment except in the case of cell and cordless phones. We would like permission to
         continue to label XM radios in this same manner, at least until we have had an opportunity to
         make changes at the factory for future production. Thanks for you assistance with this.
