Dear Mr. Fabina

Thank you for taking action based on the February 4, 2002 date for acting on the WhereNet submittal. The
original reason for CKC's FCC notification of possible need for the FCC to process this grant was based on
the calculated peak power level possibly exceeding the 200milliwatt level. This level in the 2.4 GHz band
would have exceeded the TCB limit for granting.

When this issue was presented to me on Tuesday, we re-calculated all of the parameters and found that the
initial integration process had used 20log P 1/ P2 instead of the correct process of using 10log P 1/ P2. This is
a common mistake when both E-field and power measurements are being equated. The corrected data
shows the conducted peak power level to be below 200 milliwatts.

This prompted our Mr. Dustin Oaks to contact you requesting the application to be return back to CKC
certification services. You felt that the application should remain with the FCC but stated you would bring
this issue to your Mr. Ken Nichols for final opinion. We hope you decide to return it to CKC in the interest
of time for the customer. However, if the final decision is to have the FCC process it we will support that
decision as well. We are enclosing the data corrections for that purpose.
