Software Upgrade Control Methods for a Class II permissive change to existing FCC certification grants to allow HDR, or High Data Rate, Services Dear Mr. Shaffer: EMS Technologies Canada Ltd. ("EMS"), confirms that when upgrading the Software of existing High Speed Data terminals, previously certified under FCC ID K6KHSD—440, for High Data Rate (or HDR) Services, the Software upgrade shall be: i) Performed at the manufacturing site of EMS Technologies Canada Ltd. under a Service Bulletin recall ii) Performed by third party entities which are Honeywell certified service centers. It is noted that EMS Technologies Canada Ltd is owned by Honeywell. The installation CD containing the Software for HDR upgrade shall be in a compiled binary file format and shall have no user screens. EMS Technologies Canada Ltd is the sole responsible entity that maintains control of the SW upgrade. Third party certified service centers can only install the SW using guidelines provided by EMS Technologies Canada Ltd and cannot alter the operating parameters of frequency range, modulation type, maximum output power or other radio frequency parameters outside the range under which the transmitter has been approved in accordance with the Commission rules.
