According to the way I read the rules, only Categorically Excluded licensed equipment (i.e. equipment under 1.5W conducted or EIRP) qualify with the exception of fixed devices. I am more than willing to advise you, or even file with the FCC on your behalf, but at the moment I would be doing both of us a disservice by continuing this review. Attached are the basic documents all TCBs must use to see if a transmitter qualifies for TCB approval. These must be used in conjunction with 1.1307, 2.1091, 2.1093 and OET Bulletin 65. This equipment seems to qualify as a Transmitter Category VII device on both the TCB Exclusion List and TCB RF Exposure Procedure documents. Give me a call if you need to discuss this further.
